3.9 INSPECTION AND ACCEPTANCE <br /> A. Work will be subject to inspection at all times by the Architect. The Owner reserves the <br /> right to engage an independent testing laboratory to analyze and test materials used in the <br /> construction of the work. Where directed by the Architect,the testing laboratory will <br /> make material analyses and will report to the Architect whether materials conform to the <br /> requirements of these specifications. <br /> 1. Cost of tests and material analyses made by the testing laboratory will be borne by <br /> the Owner when they indicate compliance with the specification,and by the <br /> Contractor when they indicate non-compliance. <br /> B. Inspection of the work will be made by the Architect at the conclusion of the planting <br /> period. Contractor shall request an inspection at least five days prior to the desired date. <br /> Condition of plants will be noted and recorded for reference at end of guarantee period. <br /> C. After inspection,the Contractor will be notified in writing by the Architect if there are any <br /> deficiencies of the requirements for acceptance of the work. <br /> D. Clean-Up: <br /> 1. Any soil,manure,peat,mulch,branches or similar material which has been brought <br /> onto paved areas by hauling operations or otherwise shall be removed promptly, <br /> keeping the area clean at all times. Upon completion of the planting,all excess soils, <br /> stones,and debris which have not previously been cleaned up shall be removed from <br /> the site or disposed of. <br /> 2. All ground areas disturbed as a result of planting operations shall be restored to their <br /> original condition or to the desired new appearance. <br /> 3.10 GUARANTEE AND REPLACEMENT <br /> A. Contractor shall guarantee all plants for a period of one year after date of Substantial <br /> Completion,against defects including death and unsatisfactory growth,but excepting <br /> defects resulting from neglect by Owner,abuse or damage by others,or unusual <br /> phenomena or incidents which are entirely beyond Contractor's control. <br /> B. Contractor shall inspect all beds on at least a monthly basis during the guarantee period. <br /> Report any soil loss,drainage problems,poor maintenance,vandalism, insect damage, <br /> disease or any other damage or unhealthy condition to Architect. By failing to report any <br /> condition which leads to the damage or death of a plant,the Contractor forfeits any claim <br /> of non-responsibility. <br /> ADDENDUM#1 <br /> 1607.001 -ORONO ICE ARENA(CP-2) Page 02950- 10 <br />
