DIVISION 1 <br /> CONDITIONS OF THE CONTRACT <br /> 01300-SUBMITTALS <br /> C. Where the Contractor requires approved samples to be returned, submit the <br /> number of samples required by the Contractor plus three (3) which shall be <br /> retained by the Architect and Construction Manager. <br /> 5. LIST OF MATERIALS <br /> A. Refer to Section 00700 - General Conditions, and Section 00800 - <br /> Supplemental Conditions, and as follows: <br /> B. Within ten (10) days after the award of the contract (notice to proceed or <br /> letter of intent), the Contractor shall submit three (3) copies of a complete list <br /> of all materials, products, and equipment proposed to be used in construction <br /> to the Construction Manager for acceptance. Materials shall not be ordered <br /> until the proposed listed materials, products and equipment proposed to be <br /> ' used in construction are reviewed by the Architect for acceptance and the <br /> listed materials are accepted. <br /> C. Where two or more makes or kinds of items are named in the specifications <br /> (or additional names are called for in addendum), the Contractor shall state <br /> which particular make or kind of each item he proposes to provide. If the <br /> Contractor fails to state a preference, the Owner shall have the right to select <br /> any of the makes of kinds named without change in price. <br /> D. This list shall be arranged in order of specification sections. The items listed <br /> shall fully conform to project requirements and specifications. All materials <br /> are subject to the Architect's acceptance. After acceptance, there shall be no <br /> changes or substitutions. <br /> E. The list shall clearly identify the material, product or equipment by <br /> manufacturer and brand by listing the names, for all items, including those <br /> where only one material or product is specified. Each and all material, <br /> products and equipment shall be specifically names,not listed "as specified". <br /> 6. LIST.OR SUBCONTRACTORS <br /> A. Refer to Section 00700 - General Conditions, and Section 00800 - <br /> Supplemental Conditions, and as follows: <br /> B. Within ten (10) days after the award of the contract (notice to proceed) and <br /> prior to the execution of the Contract, the Contractor shall submit three (3) <br /> copies of a complete list of all work he proposes to subcontract and the <br /> 1 subcontractors (and major material suppliers) he proposes to use in <br /> performance of the Contract to the Construction Manager for review by the <br /> Architect, Construction Manager and Owner.
