DIVISION 0 <br /> CONDITIONS OF THE CONTRACT <br /> 00800-SUPPLEMENTARY <br /> CONDITIONS ' <br /> The Contractor/Subcontractor is responsible at Contractor's/ Subcontractor's ' <br /> expense and not a reimbursable expense for providing any additional insurance <br /> Contractor/Subcontractor deems necessary to protect Contractor's/Sub- <br /> contractor's interest from other hazards or claims in excess of the , <br /> aforementioned minimum insurance coverages. <br /> 11.4 Performance Bond and Payment Bond , <br /> 11.4.1 Delete subparagraph and insert instead: The Owner shall require the Contractor ' <br /> to furnish bonds covering faithful performance of the Contract and payment of <br /> obligations arising thereunder as stipulated in bidding requirements or <br /> specifically required in the Contract Documents on the date of Execution of the <br /> Contract. <br /> 11.4.2 Add Subparagraph: The Contractor shall provide as part of his bid, a valid and , <br /> enforceable Bond which will run throughout the life of the Contract and its <br /> warranty periods. Bond shall be issued by a corporate surety company <br /> authorized to do business in the State in which the Project is located and the ' <br /> surety company shall be subject to the Owner's approval. Fully executed copies <br /> of the Bond shall be provided to the Owner, Construction Manager and <br /> Architect. ' <br /> 11.4.3 Add Subparagraph: The minimum requirement for the Owner's approval of the <br /> Surety shall be that the Surety is listed by the United States Treasury <br /> Department as acceptable for bonding federal projects and that the bond amount <br /> is within the limit set by the Treasury Department as the net limit on any single <br /> risk. There shall be no affiliation between the Contractor and the Surety , <br /> Company,Agent or Agency. <br /> 11.4.4 Add Subparagraph: For public work or other projects subject to statutory bond ' <br /> requirements,the bondform shall be the two-part AIA Form A312 Performance <br /> Bond and Material Payment Bond, 1984 edition, both parts amended to <br /> specifically incorporate the state public works amendment. In Minnesota, <br /> incorporate the following by amendment to both parts of AIA Form A312: <br /> MINNESOTA PUBLIC WORKS AMENDMENT ' <br /> This bond is furnished pursuant to the requirements of Minnesota Statutes, <br /> Section 574.26 et. seq.
