DIVISION 0 , <br /> CONDITIONS OF THE CONTRACT ' <br /> 00800 -SUPPLEMENTARY <br /> CONDITIONS <br /> Overhead/Profit Commission <br /> (a) To the Contractor and/or ' <br /> Subcontractor for work <br /> performed with their ' <br /> own forces 10% <br /> (b) To the Contractor for work , <br /> performed by other than <br /> its own forces -- 5% <br /> .3 Not more than two percentages for overhead, profit and commission will ' <br /> be allowed. The mark-up on any part of the Work a Subcontractor <br /> subcontracts will be limited to one overhead/profit figure. In addition to <br /> the Contractor's commission. The Subcontractor and Sub-subcontract may <br /> divide the overhead and profit amount as they agree upon. <br /> .4 The burden on labor may be indicated as a dollar/cents addition to the , <br /> hourly rate or may be expressed as a percentage of the extended hourly <br /> rate costs. If required by the Owner, Construction Manager or the <br /> Architect, the Contractor shall provide a detailed breakdown to justify the <br /> labor burden. The Construction Manager reserves the right to reject any <br /> labor burden which is inconsistent with other similar contractors or where ' <br /> the cost of fringe benefits are in excess of established labor agreements. <br /> The burden on labor shall not include any costs noted as general overhead. <br /> .5 Material, equipment and supply costs shall be quoted at the actual cost to , <br /> the Contractor, or Subcontractor. Upon request, the Contractor (or <br /> Subcontractor) shall submit evidence to substantiate the costs. Said costs ' <br /> shall be quoted at trade discount prices, with quantity discounts also <br /> applied where the quantities warrant. Cash or prompt payment discounts <br /> need not be credited. In any proposal with material, equipment and supply ' <br /> credits,,the credit.shall be based on the actual Contract cost of the material <br /> (including trade and quantity discounts) less any charges actually incurred <br /> for handling or returning a material which has been delivered. No ' <br /> cancellation, restocking or similar charge will be allowed unless actually <br /> incurred by the purchaser and generally will not be allowed when the <br /> product has not been shipped.
