Box 66 Orono, MN 55356 Crystal Bay, MN 55323-0066 July 16, 1997 Martin Schneider 1235 Hunter Drive Medina, MN 55391 Dear Mr. Schneider: The findings of the Orono Building Code Board of Appeals were that the proposed school use was a change of occupancy and that the building would be required to be brought into compliance for an E occupancy. The Board indicated that the building was last closest to an F-2 occupancy. The F-2 classification would allow an education use beyond the 12th grade with less than 50 occupants in any room and educational use through the 12th grade for less than 12 hours per week or four hours in any one day. The enclosed memo from Van Erickson, dated July 15, 1997, indicates a use beyond the F-2 classification. The City must require you to limit the use to the F-2 classification immediately and to bring the building into full compliance for the F-2 classification so that the City may issue a certificate of occupancy. A plan for completion of the work to comply with the F-2 classification must be submitted before July 28, 1997. On July 21, 1997, the City will begin monitoring the building's usage for compliance with the F-2 classification. If the deadline for submittal is not met, or if the building is not used in compliance with the F-2 occupancy, the City will initiate legal action.
