Flessner stated if you start adding up the
value af these 16 pmperties,it is hue and is greater than what is being proposed for tlus corner lot.
McMillan notHennepin Caunty wanted to make County Road 15 four lanes aad the City fought againt
that back in the 199Us. McMillan cammented she cannot imagine what a four lane road would have done
to the area. Mcltillan stated a Iot of ideas have been discussed about Couirty Road 15 over the years an+d
that the City has worloed closeiy with the County on thoe ideas. MeMillan stated citizens do have a lot
of input and that a number of citizens do not wastoplights on Ccunty Road 1 S. As a result of that, the
resies have to deal wittth what is thcre today.
Printup aaced Nir.Winston to touch on ttlegal points thahe mentianed he had now that the City
Attorney ia present.
Jahn Winston stated his obervation of the last metig was that the Council was more ooncerned abaut
mattes such as setbaek, hardcflveT,and the driveway but did not eoem to tauch on the variances ttat were
bein, quested. Win$ton stated from a technical standpoi, the record did not scem t,o have anything in
it denying the variances and that it sceme+d like tho variances were a factor of the size of the lot and the
width of the lot, which the homeowner does notave any control over. Wixton stated&om a legal
standpoint,it seemed to him that they had that eoveredhat and that the applicant has lesseated the
encmachment uatil the sefback siIIcx that time. Winston stated there ciid not seem to be anyting in the
recflrd tat the Coun,cil+oa1d deny those variance.
Viaston stated from his prsonal observation, the site seems to work extremely we11 from a safety
stanoint in that peflple would not have to back out into the street. Winston stated his car dces not have
a baokup Camera and that it is a safety concern. The praposdesign takes parking offthe street.
Winston stated when he comes to thet site,he is more 1ik,ely to park onsite when there is a cin.ular
driv8way. Not lxaving the two eurb cuts wouldxacerbate the situatian.
Winston stated he is familiar with this builder's work and that he has aen a number of homes he has
haadlal. Wirtcn stated he wauld like the nighbors understand that what will be vanshere will
be a nice loolong 6uilding and thst the Tufea's have hired a first-class buildet. Winston tmmented he
would be luclry to have t1is home in his neighborhood sad that he►ould like to assure the neighbors that
the builder constructs quality homes ad it will be landscaped.
Winskon teiterAted he did not se anything in the prior recflrd that would support a denil of this
application and that they have doae their best tv make this design the very best for the lot.
Walsh stated in his view Mr.Winston was watching another year's video because the Council did have
issues with the curb cuts and tkat they did not see that as a prsctical difficulty since the A'Phr o'i'►er
lmew he was buying a eorner lot. VValsh indicated he raisod issues with the setback and that due to those
issues hc asked that it be redesigned, Walsh stated he wants to set the facts straight and that he did heve
an issue with the practical difficulties since they lmew they were buying a corner lot.
