REGULAR MEETING OF THE ORONO COUNCIL HELD APRIL 23, 1984. PAGE 5 <br /> #804 PAINTERS CREER Zoning Administrator Mabusth stated that the Dunn <br /> property was actually subdivided illegally and that <br /> they did not have the required 5 acres in area. <br /> Mabusth stated that the Dunn property will now have <br /> additional land to allow area for an alternate septic <br /> system. <br /> Councilmember Frahm noted that the developer would <br /> have still been short even if they had not given <br /> additional land to the Dunn property. rrahm noted <br /> that by granting that credit the City would be setting <br /> a negative precedent. <br /> Mayor Butler asked City Administrator Benson if the <br /> City needs that 100 ' for McCulley Road. <br /> City Administrator Bensonstated that McCulley Road is <br /> a Minnesota State Aid (MSA) road and had to f ol low the <br /> 100 ' requirement. <br /> Councilmember Adams moved, Councilmember Hammerel <br /> seconded, to approve the conditional use permit for a <br /> PRD and preliminary subdivisionfinding all standards <br /> of the PRD and RR-lA code have been satisfied and that <br /> all residential units have adequate areas for primary <br /> and alternate septic drainfield sites, all subject to <br /> the following conditions : <br /> l . Create additional outlot to be set aside for use of <br /> Dunns at 4740 Bayside. <br /> 2 . Dedication of 33 ' right of way for County Road 84 . <br /> 3 . Residential pads to be designated as lots on final <br /> plat with language to show density credit of Outlot A <br /> and adjusted Outlot B. <br /> 4 . Outlot B to be ad justed in area must be exclusive <br /> of McCulley Road right of way per Council directive. <br /> 5. Open space easement over Outlots A and B to assure <br /> density credit for this PRD. <br /> 6 . Underlying road and utility easements to the City <br /> over road outlot. Road must be designated as outlot. <br /> 7 . Conservation and flowage easement over wetlands <br /> area, overland drainage courses and storm sewer if <br /> applicable. <br /> 8. Lot 10 will require a separate access permit from <br /> Hennepin County. <br /> 9 . �pplicant to provide copy of restrictive <br /> covenants that will deal with the use and share in <br /> costs for upkeep and maintenance of the open space <br /> area, road outlot, etc. <br />
