The parcel is still one parcel and 2605 W. Lafayette Rd. <br /> one lot. The proposed driveway does not change the (Continued) <br /> character of the lot. We are not combining two <br /> parcels of land for other purposes, public, private, <br /> or road easement does not apply to the Hepp proposal. <br /> If it should, this should be considered as a variance . <br /> This area is unique and not unusual to the Hannah <br /> easement. Drainage problems do not exist that we <br /> are aware of pertaining to the building envelope . <br /> There are some unique conditions such as the cul de <br /> sac and lagoon. <br /> We do have many hardships. One is being denied <br /> occupancy since my client purchased the land for a <br /> residence. Mr. Hepp is being transferred to Italy <br /> and wants to retain the lots for himself, wife , and , <br /> children and the City is imposing a real hardship <br /> if they are not allowed to use the property. The <br /> Council ' s statement that the applicant plans to sell <br /> the property for a greater value is not true. The <br /> Council ' s action on variances are quite technical and <br /> have not been well thought out. Subdividing the <br /> larger parcel into two lots will not cause deterioration <br /> of the area. <br /> Mayor Van Nest: Mr. Jevne, your application does not <br /> meet City performance standards simply because it has <br /> been assumed that this proposal would not require • <br /> variances, when in reality, there are variances required. <br /> The easement required to serve the existing house on <br /> this lot leaves a building envelope that is much less <br /> than required in a standard lot in the one acre zone. <br /> In fact, the building envelope is only 39� of standard <br /> with a 20 ' wide easement and a 10 ' building setback. This <br /> is reduced to 23� with the required 35 ' building setback. <br /> If the easement is granted at the required width of 50 ' <br /> with a 35 ' building setback, then the building envelope <br /> is reduced to only 180 of standard. The location of the <br /> easement destroys the lot. This is not a reasonable <br /> building site, if youu are to meet the City code requirements. <br /> I wish to note here that Mr. Hepp ' s application created the <br /> easement, no one else did. <br /> Mr. Jeven: Yes, that is correct. <br /> Mr. Tom Lowe , 2630 West Lafayette Road: The hardships <br /> were in existence when Mr. Hepp purchased the lot. <br /> Mayor Van Nest moved, Paurus seconded, to adopt RESOLUTION #1247 <br /> Resolution #1247, A Resolution Denying Bruce F. 2605 W.
