Rhode insists on revising nis house plan and VARIANCE <br /> location from that approved in Resolution #851, then 1410 Bohns Point Rd. <br /> I recommend and request Cour.cil direction to refer (Continued) <br /> said new application to the Planning Commission for <br /> formal, standard review. <br /> Council Meeting - June 30 1980 <br /> Present were : Jack Rhode , his attorney, James <br /> Swenson, Jason Becker, and Gregg Hannah. <br /> Mr. Swenson presented the City Council with a letter <br /> from the Lauers, who live next door to the Rhode <br /> property, stating that they agreed with the location <br /> of the proposed relocation of the house. <br /> Mayor Van Nest stated that Mr. Jack Rhode has shown <br /> us the same plat prepared by the Gary Gabriel <br /> Land Surveyors showing the proposed Rhode residence <br /> as drawn on April 15, 1980 . The surveyor states that <br /> this is the best area to place the house , which puts <br /> the house in the center of the lot and will allow <br /> an area for landscaping on either end of the lot <br /> after the carriage house is removed. <br /> Mr. Swenson reviewed Resolution #851 stating that <br /> they would like Mr . Rhode to build without a <br /> restricted covenant on the easements that was originally <br /> included in the resolution. <br /> He stated that he does not believe that the application -- <br /> should be referred back to the Planning Commission - <br /> because the Planning Commission had already recom- <br /> mended the buildability of the lot in relation to the <br /> easements. <br /> Mayor Van Nest stated that we are now being requested , <br /> to change the front setback line and that he has not <br /> heard any hardship or reason for the change . This <br /> change should be reviewed by the Planning Commission <br /> to determine if there is a hardship or other reasons <br /> for a change. He stated that the easement and dock use <br /> area be negotiated by Mr. Rhode and the two easement <br /> holders. <br /> Mr. Jason Becker stated that he felt it was unfair to <br /> him to make any decision tonight due to the fact that <br /> he has not had time to prepare a reply. Mr . Becker <br /> stated that he felt due process is necessary to make <br /> any changes, therefore, he felt that the new application <br /> should be referred to the Planning Commission for review. <br /> Butler felt that it was not necessary to be referred <br /> to the Planning Commission because it is still a house <br /> on a lot and she does not feel that it is a material <br /> change .
