REGULAR MEETING OF THE ORONO COUNCIL, JUNE 30 , 1980 Page 23 <br /> Jeanne Mabusth, Zoning Administrator, entered into VARIANCE <br /> the record the request of Steve Haverberg, 3215 3215 Crystal Bay Rd. <br /> Crystal Bay Road, for a variance dated June 25, 1980 , #566 <br /> which states: Steve Haverberg <br /> Zoning District: LR-1C <br /> Side yard setback variance : <br /> Request - 10 ' <br /> Existing buildings - 3 . 7 ' <br /> Existing slab - 2 ' approximation <br /> Proposed - 2 ' approximation <br /> Steve Haverberg has constructed a screened porch <br /> 12 ' X 18 ' over an existing 26 . 2 ' X 12 ' slab. <br /> The porch was constructed without a building permit <br /> and the benefit of a zoning review. The owner has <br /> been transferred to Seattle and has been absent from <br /> his home for the past few months. The house has <br /> been sold and Mrs. Haverberg has finally completed <br /> the variance application for the City ' s review. <br /> The existing slab, not considered an encroachment, <br /> extends to within two feet of the west side property <br /> line. The screened porch is considered an encroachment <br /> and requires approval of a side yard variance before <br /> construction. Neighbors have both written letters <br /> approving of the construction. Mr. Schabilla, a <br /> neighbor on the west side, is concerned that the porch <br /> area never be enclosed because of the location of his <br /> house to the encroaching structure. <br /> If Council accepts the recommendation of the Planning <br /> Commission, staff advises that in addition to the <br /> actual encroachment being certified by the surveyor <br /> • that a legal description of that portion of the screened <br /> porch encroaching into the 10 ' side yard setback area <br /> be furnished and that a resolution forbidding the <br /> enclosure of the subject area be filed by the City <br /> against the Haverberg property. , <br /> Council Meeting - Jurie 30 , 1980 <br /> Butler moved, Hurr seconded, to request staff to draft <br /> a resolution approving the variance request of Steve <br /> Haverberg, 3215 Crystal Bay Road, stating that the <br /> screened porch never be enclosed and made a part of the <br /> house , and to be entered into the chain of title . <br /> Motion, Ayes (4) - Nays (0) . <br />
