+ YtEGULAR MEETING OF THE ORONO COUNCIL, APRIL 14 , 1980 Page 4 <br /> 38. 201 - Requires all parking to be on the lot, not CONDITIONAL USE PERMIT <br /> on the right of way as this existing area is. 4685 North Shore Drive <br /> This section also prohibits any parking in any (Continued) <br /> required yard. (i.e. the required 35 ft. deep front <br /> yard) exceptions are provided for a 10 ft. setback, <br /> but only in side or rear, not front, yards. Thus , <br /> such parking must be at least 35 ft. from the right <br /> of way. � <br /> 38. 201: R Districts - Within all "R" Districts all <br /> vehicles normally owned or kept by the occupants <br /> on the premises must have a garage stall or open <br /> parking space on the same lot as the principal use <br /> served. Garage stalls accessory to residential <br /> s�ructures may be located anywhere on the lot <br /> other than a required yard area except that such <br /> garages may be located to within ten (10) feet of <br /> an interior side lot line and to within ten (10) <br /> feet of a rear lot line subject to Section 31. 300ff. <br /> Open parking spaces on lots must have a location <br /> other than a required yard except that such parking <br /> may be located in a rear yard to within ten (10) <br /> feet of an interior side lot line and to within <br /> ten (10) feet of a rear lot line. <br /> 38. 241 in addition, prohibits any parking space <br /> from being accessible directly off any public <br /> street, requiring an intervening driveway to <br /> prevent, as in this case, direct backing onto a <br /> public street. <br /> 38. 240 Design and Maintenance of Parking Area - <br /> 38. 241 - Access : Parking areas shall be designed <br /> so as to provide an adequate means of access to a <br /> public alley or street. Said driveway shall not <br /> exceed 30 feet in width at the public walk center <br /> line and shall be so located as to cause the least , <br /> interference with traffic movement. All off-street <br /> parking spaces shall have access off driveways and <br /> not directly off of a public street. <br /> Remember too, that there are additional hill and <br /> curve restrictions at this location which further <br /> reduce visibility. Therefore, not only is the <br /> existing parking intuitively bad, it is contrary to <br /> zoning code requirements and should be abated <br /> whether or not any new driveway is built. <br /> The staff,therefore, recommends approval of the <br /> requested Rest Point Road driveway as per the <br /> March 7, 1980 memo, provided the existing parking <br /> and eastern driveway along North Shore Drive are <br /> removed and restored per the zoning code requirements <br /> and per the Hennepin County permit requirements. I <br /> suggest approval per the attached resolution. (Continued) <br />
