Motion, Ayes (4) - Nays (0) . <br /> Mr. & Mrs. James Rivers and their legal representa- REZONING <br /> tive, Mr. Lou Oberhauser, were present. 1440 Shoreline Drive <br /> #539 <br /> Alan Olson, City Planner, reviewed the extensive James Rivers <br /> background data dated April 10, 1980 , which states : Windward Marine <br /> This is a technically complicated application <br /> because of varying ownership interests , previous <br /> applications and rulings , and an overlapping <br /> history of use on the property. <br /> Simply put, Mr. Rivers is requesting rezoning of <br /> three parcels of land in order to facilitate <br /> reconstruction of his Browns Bay docks , replacing <br /> � buoys and the existing dock structure with a new <br /> floating dock. The area to be rezoned is shown on <br /> Exhibit 1. The proposed dock rearrangement is <br /> shown on Exhibits 2 & 3. <br /> BACKGROUND INFORMATION - In 1979 , Windward r4arine' s <br /> 1979 commercial dock license application included <br /> a proposal for a major rearrangement of the docks <br /> on Browns Bay. In review of that change, staff <br /> took copies of the proposed site plan and compared <br /> them to platting maps. � We then took the 1974 legal <br /> descriptions for the B-2 zone and marked them on <br /> the plat maps and the site plans. At that point, <br /> it was apparent that the proposed docks would have <br /> extended beyond the legally described zoning district <br /> boundary. In addition, some of the existing dockage <br /> did not conform to LMCD' s required side setbacks. <br /> Resolution #1023 was adopted granting the 1979 license <br /> based upon the previous year' s dock arrangement but <br /> denying those slips encroaching beyond the B-2 line. <br /> This was subsequently amended to allow in 1979 the <br /> same number of slips previously licensed pending <br /> review of the zoning issues.
