Therefore , <br /> appendix D which is based on estimates is obviously incorrect . <br /> Mayor Van Nest stated that for all of these reasons , the City <br /> of Orono would do what it could do in front of the Metropolitan <br /> Council , the Metropolitan Waste Control Commission, the Environ- <br /> mental Quality Board , the PCA and the EPA to prevent the installa- <br /> tion of the interceptor across rural Orono. Ne indicated that <br /> in the event that we were not able to stop the interceptor <br /> in an administrative manner , then the city would seek an injunc- <br /> tion from the courts under the Environmental Rights Act to <br /> insure that the environment would not be damaged as is proposed <br /> by the construction of the interceptor. Mayor Van Nest noted <br /> that it was a mistake ta have brought the Maple Plain plant <br /> within the MSSR line in the first place , but that you cannot <br /> solve one mistake with the creation of another mistake. Some- <br /> one has to say no and to protect the rights of the public . <br /> Mayor Van Nest noted that as to any present odor problem in <br /> Maple Plain that that is caused because of the excessive <br /> infiltration not because of the phosphorous which will be <br /> solved without an interceptor. <br /> Alan Larsen stated that he was going to think about the issues <br /> raised and would review the prior Harza study and the applica- <br /> bility of a land application of the effluent . <br /> Mayor Van Nest indicated that the City of Orono had executed <br /> an agreement with the City of Medina in regard to taking the <br /> effluent from Medina-Morningside and piping that into the <br /> existing interceptor in Long Lake to solve that problem at <br /> the local level instead of spending millions of dollars of <br /> taxpayers ' monies to drive an interceptor all the way across <br /> rural Orono. The City of Orono can control the use of this <br /> new sewer installation because a hydraulic limitation prevents <br /> any new growth other than what is planned. <br /> The MPCA staff indicated that they would review these comments <br /> and would like to review their conclusions with the City of <br /> Orono prior to the final action on their part. <br />
