P�otion, Ayes (4) - Nays (0) . <br /> Dick Benson, City Administrator, presented the HOFFP4AN & CLARIC MATTER <br /> City Council with a memo from John Gerhardson, 73-1 Restoration <br /> Public Works Coordinator, dated P�Iay 31, 1978, <br /> which states : <br /> For the past several months, the City of Orono <br /> has been trying to settle a 73-1 restoration <br /> claim with P�r. Robert Hoffman, 790 North Arm <br /> Drive and Mr. Craig Clark, 780 North Arm Drive. <br /> On October 4, 1977, a meeting was held with <br /> Mr. Clark, Mr. Hoffman, Mr. James Robin, <br /> attorney for Clark . & Hof�man, Mr. Benson, <br /> City Administrator, and myself. At that <br /> meeting, we asked Mr. Clark & P�Ir. Hoffman if <br /> a picture was available to us so that we could <br /> see what the property looked like before <br /> construction began_ We were told no picture <br /> was available. <br /> We then net on the site to determine what <br /> had to be done. The final determination was <br /> to cut a diagonal ramp from the top of the hill <br /> to the lakeshore level, upgrade .the lower area <br /> and seed and replace a 3" diameter maple tree. <br /> I received estimates from contractors and the <br /> City offered Clark and Hoffman a cash settlement <br /> of $550. <br /> This offer was not acceptable to them and an <br /> agreement was written by the City Attorney <br /> explaining what would be done by the City to <br /> restore the property. <br /> On i�tay 22, 1978, I met with them to explain <br /> that the City was going to do the following: <br /> 1. Cut a diagonal slope from the top of the <br /> hill to the lakeshore level. After this <br /> slope is made, there would be� no seeding <br /> or sodding. <br /> (Continued) <br />
