He stated his opinion that Orono zoning <br /> ordinances should not have a retroactive effect <br /> on the Partenwood plat covenants. He also stated <br /> that the proposal for docks would meet current <br /> I�iCD requirements. <br /> Some discussion ensued as to the legal aspects of <br /> this situation, and to whether one or two docks <br /> should be allowed. <br /> Motion by Hammerel and seconded by P4cDonald to <br /> approve request of a variance for construction <br /> of not more than two private docks on Outlot A <br /> and granting access for Lots 1 & 2, Block 3, of <br /> the Partenwood Subdivision, in conformity with the <br /> conditions set forth in the existing Partenwood <br /> Subdivision Plat approval and the restrictive <br /> covenants attached thereto, dated June 14, 1972. <br /> Ayes (3) : Hammerel, Hannah, and McDonald. <br /> Opposed (2) : Frahm and Wilson. ?�otion carried. <br /> Staff Note - May 16, 1978 <br /> Council may wish to apply a joint use dock license <br /> -o this outlot and/or to require one jointly used <br /> sock with a maximum boat limit. If .so, a resolution <br /> may be in order. <br /> Council Meeting - June 15, 1978 <br /> P4r. Alan Olson also commented that the City might <br /> want to consider the joint use of only one dock. <br /> Mayor Van Nest reviewed the covenants and <br /> restrictions of Outlot A: <br /> Covenants and Restrictions of Outlot A <br /> It is intended that Outlot A shall be owned by the <br /> owners of Lots One (1) and Two (2) .of Block Three <br /> (3) of Partenwood_ It is intended that the owner <br /> of Lots One .(1) and Two (2) of Block Three (3) of <br /> Partenwood shall each have an undivided interest <br /> in Outlot A. The purpose of Outlot A is for the <br /> sole reason of providing a place for. those two <br /> lots to have lake access and to maintain a dock <br /> for the pleasure and recreation of the owners <br /> of those two lots.
