WALTERS PORT <br /> (Continued) <br /> Councilmember P4assengale: Are riparian rights <br /> jeopardized by this move? <br /> Mr. Ellis: We are being asked to do things <br /> according to your rules and not to standard <br /> rules and regulations. <br /> P'lr. Olson; City Engineer, repeated PRr. �llis ' <br /> statement at a previous Council meeting when <br /> Mr. Ellis stated he would do whatever the <br /> engineer recommended. <br /> Motion carried, Ayes (5) - Nays (0) . <br /> P'Iotion #2 - Homeowners Association <br /> PAayor Van Nest moved, Pesek seconded, to enforce <br /> the stop work order on all permits for the I9alters <br /> Port Homeowners Association until: <br /> 1. Plan is submitted and approved <br /> 2. Agreement to repair west �aall received <br /> 3. Letter of credit to assure repair of west wall <br /> 4 . Spoils to be removed <br /> 5. I'encing to be installed to protect area by <br /> P1ay 15, 1978 at 4 : 30 P.r�. <br /> o. All other items included in John Gerhardson' s <br /> memo of April 26, 1978 <br /> 7. All other conditions except for fence to be <br /> met by 21ay 25, 1978 Council meeting. <br /> 8. fiold harriless agreement to the City <br /> Discussion follosaed. <br /> P4r. ��illiam Reese, president of the Homeowners <br /> Association: We will meet to approve funds to <br /> r.ieet these conditions as soon as possible. <br /> t�ir. Blunt: We would not have proceeded if we knew <br /> we could not use the spoils in the area. We now <br /> have to move spoils out and other dirt in. The <br /> spoils are not harmful and we would want to have <br /> them analyzed to determine if we could use them. <br /> Jim Olson, City Engineer: The spoils that are <br /> dredged contain nutrients that are harmful to the <br /> lake. <br /> Mayor Van Nest: Your permit and all permits <br /> include the language that all spoils are to be <br /> removed. This is standard language. You are <br /> ��erating under permits that do not allow spoils <br /> to be used in the dredging area. <br /> 2�otion carried, Ayes (5) - Nays (0) . <br />
