Mr. Ellis: The association approved riprap. The Minnehaha Creek Watershed District approved all steel sheeting. 6�e want this resolved. Mr. DeGregory: I do not feel that we should be hindered to install our own riprap. Some individuals have r►uddied the water for our riprap. Mr. Ellis: I wanted Mr. Jim Olson to tell us what we should do. 6�e want to comply. We requested information fror,� the City Engineer to take to the Watershed District. The engineer did not submit a letter to us. Mayor Van Nest: I do want to see the west wall repaired before more work is done. Mr. Ellis : We are in compliance. Are there two sets of standards? :��tion #1 I�layor Van rlest r,ioved, Pesek seconded, to reaffirm the March 16, 1978 motion �shich states : "Pesek moved, Butler seconded, to approve the granting of the permit to Messers. Ellis, Crist, and DeGregory for riprap subject to the following: 1. The plans are feasible. 2. The riprap is to be in accordance with the City standards and specifications and subject to the engineer' s approval. 3. The permit is contingent upon approual of other agencies. 4. That although an opportunity was given during several Council meetings for the Homeowners Association to submit a legal opinion, with copies of the Homeowners ' Association Agreement restrictive covenants and map to support their argument that the individual property owners had no property right to riprap, the Homeowners ' Association failed to provide such a legal opinion. 5. Although not required, the applicants submitted a legal opinion which stated that the applicant had a legal right to proceed." Council Iieeting - riay 11, 1978 6. Riprap to cross at 929. 4 elevation.
