Some individuals <br /> have r►uddied the water for our riprap. <br /> Mr. Ellis: I wanted Mr. Jim Olson to tell us what <br /> we should do. 6�e want to comply. We requested <br /> information fror,� the City Engineer to take to the <br /> Watershed District. The engineer did not submit <br /> a letter to us. <br /> Mayor Van Nest: I do want to see the west wall <br /> repaired before more work is done. <br /> Mr. Ellis : We are in compliance. Ellis, Crist, and DeGregory <br /> for riprap subject to the following: <br /> 1. The plans are feasible. <br /> 2. The riprap is to be in accordance with the City <br /> standards and specifications and subject to the <br /> engineer' s approval. <br /> 3. The permit is contingent upon approual of other <br /> agencies. <br /> 4. That although an opportunity was given during <br /> several Council meetings for the Homeowners <br /> Association to submit a legal opinion, with <br /> copies of the Homeowners ' Association Agreement <br /> restrictive covenants and map to support their <br /> argument that the individual property owners <br /> had no property right to riprap, the Homeowners ' <br /> Association failed to provide such a legal opinion. <br /> 5. Although not required, the applicants submitted <br /> a legal opinion which stated that the applicant <br /> had a legal right to proceed." <br /> Council Iieeting - riay 11, 1978 <br /> 6.
