Braun received a carbon copy of a SUBDIVISION <br /> letter addressed to Mr. Schnell fror.► the Cit��, dated 3024 Casco Point Road <br /> Febzuary 14 , 1978 , which states: � (Continued) <br /> I would like to reply to your letter of Februarv 10 , <br /> 1978 regarding the Joe Braun subdivision. <br /> The final subdivision approval by the City Council <br /> must be in the form of a resolution which will set <br /> forth any conditions and or requirements as <br /> deterr,tined by the Council. The City staff is <br /> currently recommending to the Council that, should <br /> the Council wish to approve the plat, the following <br /> items be corapleted by P�Ir. Braun: <br /> l. Updated final plat drawing including a drainage <br /> easement shown thereon. <br /> 2. Executed drainage easement running to the City. <br /> 3, Current title opinion addressed to �he City td <br /> ensure proper and complete execution of all <br /> documents. <br /> 4. Payrient of one additional water unit charge of <br /> ,�530. 00. <br /> 5. Payment of all delinquent taxes due. <br /> 6. Payment of the park dedication fee of $2, 000. <br /> 7. Submission of complete foundation plans and <br /> engineering data, drainage control plan, and <br /> sedimentation and erosion control plan for <br /> review and approval of the City engineer prior <br /> to issuance of any building permit. <br /> These recommendations arise from the facts and <br /> documentation contained within the file which you <br /> reviewed and from the recommendations of the City <br /> engineer as contained in the attached letter dated <br /> February 6 , 1978 which was delivered to the City <br /> on I'ebruary 9, 1978. <br /> End of letter <br /> Mr. Singer continued by stating that these delays <br /> are creating a financial hardship for Mr. Braun. <br /> Mr. Schnell: P�Iy client was not aware of a one year <br /> statute of limitation and this policy which we <br /> question is now our problem. <br /> Mr. Bruce 2dalkerson, City Attorney read Ordinance <br /> 34. 552 and definition on page 8 , which states : <br /> 34. 552.
