We have no <br /> � housing maintenance code and the building <br /> code does not require painting. Permits <br /> � are authorization to proceed with work and <br /> do not automatically require any building <br /> � permit for 1251 Briar Street until such <br /> • time that some construction is proposed. <br /> + 4. Public Nuisances: These sections have been <br /> addressed by Chief Kilbo. <br /> • 5. Animal Regulation: This section alleges <br /> � unsightly conditions and health hazards of <br /> rodents, flies, insects and accumulation <br /> � of manure. Building and Zoning has had no <br /> . previous complaint of this , only the cornplaint <br /> of rooster crowing and the general complaint <br /> of chickens being kept. Since this petition, <br /> we have not been able to verify any rodents <br /> � or undue numbers of flies or amounts of manure, <br /> but obviously the keeping of any fowl, especially <br /> in a small pen, will cause some manure buildup <br /> that can be objectionable. The necessary feed <br /> for the birds may attract rodents. Section 110 <br /> • deals with "aniMals" specifically, not fowl, but <br /> the conditions may be similar. It is questionable <br /> � what type or amount of evidence would be necessary <br /> for prosecution. Perhaps sworn complaints by <br /> � the neighbors would be necessary. <br /> � 6. AniMal Units: The zoning code permits as an <br /> , allowed use the keeping of domestic animals <br /> including chickens in the RR-1II zone providing <br /> ' one acre is available for the house and one <br /> acre each animal unit (50 fowl) . This lot is <br /> � only 10, 500 sq. ft. (25� of one acre) , and <br /> about a dozen chickens are being kept in a <br /> � pen and hen house. The practice of keeping <br /> these birds apparently predates the zoning <br /> � requireraents, making the hen house location <br /> • substandard and the use non-conforming. If <br /> the practice does indeed predate the code, it <br /> � may be "legal non-conforming". Section 31. 106 <br /> requires abatement of structure of less than <br /> � $3, 000 market value, no later than January 1, <br /> 1978. This use would apparently fall under <br /> � this requirertent, meaning that P�ir. nuast could <br /> . have until January to abate the use. Section <br /> � 32. 490 provides for review of any conditional <br /> use (such as a legal non-conforming use) upon <br /> neighbors' petition. This is what we are doing <br /> � now.
