P�r. P�iuhich and P4r. Jacobs have <br /> �discussed the complaints with Mr. nuast. The <br /> • Building & Zoning Department has the following <br /> comments and answers to the points raised by <br /> ` the petition: <br /> � l. Potable Water Supply: The staff has had no <br /> complaint from the occupants of 1251 Briar <br /> � Street concerning lack of water. ��le have <br /> . no housing maintenance code and no �robable <br /> cause to enter the premises to investigate. <br /> � As in Duluth, potable water can be bottled. <br /> While the health of any citizen is imPortant, <br /> � the ability of the City to invade existing <br /> residences is very limited. <br /> 2. Unsafe Buildings-Condemnation: The professional <br /> • staff has no reason to assume or expect this <br /> • home to be unsafe. It may be unsightly, but <br /> that does not warrant condemnation. The <br /> � structure appears sound from the outside. <br /> ti9e have no housing maintenance code and no <br /> a probable cause to enter the premises to <br /> investigate possible structural or wiring <br /> � defects. P4ost older homes do have inadequate <br /> • wiring and may not meet all current code <br /> � requirements, but there is no legal mechanism <br /> to require upgrading. Normal condemnation or <br /> repair orders are issued after fires or <br /> ,� tornados, etc. and are not caused b;� "wind- <br /> shield surveys" . (Continued) <br /> � <br /> � <br />
