Bruce Malkerson, Esq. <br /> Popham, Haik, Schnobrich, Kaufman & <br /> Doty , Ltd. <br /> 4344 IDS Center <br /> � Minneapolis, r9innesota 55402 <br /> � Gentlemen: <br /> � On Monday, August 8 , 1977 , Jack Rhode appeared before you <br /> in request of certain variances which �aould allow him to construct <br /> a single family dwelling on his lot adjacent to Crystal Bay on Lake <br /> � I��innetonka and to retain the existing carriage house for garage and <br /> storage purposes . Subsequent to lengthy discussion a resolution was <br /> ` proposed by Ms. Butler which would have allowed Mr. Rhode to construct <br /> • his dwelling as proposed in his revised proposal and allowed him <br /> to build in front of the average distance from which the adjacent <br /> � dwellings were set back from the lake shore, though still set back <br /> significantly more than the minimum 75 feet. This latter aspect of <br /> � the resolution was proposed after Mr . Bruce I�4alkerson , Esq. , explained <br /> that the "average set back" rule �aas concerned primiarly with sight <br /> � lines and the council noted that Mr. Rhod_e ' s proposed building loca- <br /> tion would not block his northern neighbor ' s view of the lake and <br /> � that the neighbors to the south agreed to the proposed location . <br /> ` At the very end of the discussion , the council was apprised <br /> � of the fact that there were in existance two walkway and dock easements <br /> on T�Ir. Rhode ' s property. This fact raised certain issues which <br /> � according 'to Mr. Malkerson neither he nor the council were prepared <br /> to deal with without further factual investigation . This letter and <br /> � attached exhibits are designed to help the council better understand <br /> i the dock eascmcnts and how they do or do not affect Mr .
