. RF:GtJLAR MEETI2IG OF TI3E ORONO COUNCIL, JUNE 13, 1977 Page 16
• Henry Muhich, Building & Zoning Administrator, VARIANCE
stated that the application for a variance of 4735 Tonka View Lane
T. Kenneth Rud, 4735 Tonka View Lane, was tabled #253
at the May 23, 1977 Council meeting for further T. Kenneth Rud
• review.
 Staff - riay 26 , 1977
Checked site again for reconsideration. If this
were to be approved as two sites, it would be
difficult provide access for the lot on Block 4.
Access onta _ County Road #19 would be extremely
hazardous because of the two blind curves and
topography of the subject property. To provide an
i alternative access to Tonka View Lane would require
extensive filling and destruction of most of the
foilage on the property. The existing elevation
of this lot is much higher than County Road #19 .
Any added fill would only raise this drop-off to
County Road #19. The City has had seven drainage
problems in the area before. We have just recently
• completed a storm drain project for this area.
Any added fill would probably change the direction
 of drainage.
The City just recently denied requests of Mr. Doerfler
and 4Jaconia Homes for smaller building sites on the
adjacent Block 2. Final determination on these
• requests was combination of lots for two building
sites only. Applicants agreed.
Block 3,just west of Adams Street, has three
structures. The old store building on combined
Lots 1 & 2, (4736 North Shore Drive) . This building
permit was issued in 1954. A home on combined
Lots 7 & 8 (4784 North Shore Drive) . This building
• permit was issued in 1966. A home on combined Lots 3 & 4
• (4750 North Shore Drive) . This building permit was
issued in 1972 justified by staff as a legal building
site because of a variance approved in 1966 . This , I feel,
was a case of misinterpretation by staff. Two more
substandard sites are located on Block 3 - combined
Lots 5 & 6 and combined Lots 9 & 10.

Staff - June 8, 1977

I would like to reaffirm the fact that this property
consists of two parcels under common ownership.
Based on the Orono Comprehensive Plan, the City has
adopted a zoning ordinance to provide for the health,
saiety and welfare of the public. Over development
in lakeshore residentially zoned districts would
result in excessive hardcover and storm water runoff
into the lake.
 (Continued)
