• REGULAR MEETING OF THE ORONO COUNCIL, JUNE 13, 1977 Page 17
A reduction in this natural filtration would result VARIANCE
in pollution of Lake Minnetonka and ground water 4735 Tonka View Lane
supply. (Continued)
Our current zoning ordinance and the ordinance
• previously adopted in 1967 (Section 31. 201)
states that a lot of record is one under single
separate ownership, not two adjoining lots in
corunon ownership.

Council Meeting - June 13 , 1977

Mr. PIuhich also displayed maps showing how other
substandard lots in the area were combined to
• provide buildable lots. Mr. Pduhich also cornmented
that there are other lots in the area that could be
combined to this proposed site to create a standard
buildable lot, which will protect storm water
runoff and other environment concerns in the area.
Mr.Haglund, representing Mr. Rud, commented that
the City has an obligation to allow Mr. Rud to
build a house on a small lot, particularly when
sewers are available and when small lots
predominate. This proposal is not a threat to
safety, health and welfare of the public. The
City is over-turning prior Council action and is
denying low income housing. There is no factual
asis for the Zoning Aciministrator' s recommendations.

• Mayor Van P1est commented that denser development
will create other watershed problems. There is
documented rationale for the present zoning and
City policy is not to allow development on sub-
standard lots or to create within a division sub-
standard lots. These particular lots were platted
many years ago and the zoning has changed as has
• many other requirements which are in the public
interest and cannot be ignored. Other properties
in the past have been combined and in the past,
assessments have been abated to provide one buildable
 lot.
Mr. Rud was asked: when did he purchase the property?
Pdr. Rud: Not sure of definite date.
IIayor Van Nest moved, Paurus seconded, to table the
request of T. Kenneth Rud, 4735 Tonka View Lane,
until the meeting of June 27, 1977 to allow staff
tine to review previous Council actions and common
ownership status. Plotion, Ayes (4) - P1ays (0) .

i
•
