� <br /> , REGULA� MEETING OF THE ORONO COUNCIL, MAY 23, 1977 Page 11 <br /> � Planning Commission Meeting - May 16 , 1977 VARIANCE <br /> 4799 Tonka View Lane <br /> Two representatives presented a newly executed (Continued) <br /> ��urchase agreement for adjacent Lots 6 & 7. <br /> They agreed to combine all five lots (6-10) into <br /> . one building site granting an access easement to <br /> Lucille Olson of 4784 North Shore Drive. The <br /> Planning Commission commended the applicant <br /> for their cooperation and compliance and recom- <br /> � mended approval of any needed lot area variance <br /> conditioned upon combination and provided the <br /> � proposed building will meet all setbacks. All <br /> five lots contain about 34, 500 sq. ft. requiring <br /> � an area variance of 9 ,000 sq. ft. <br /> � Staff - May 17, 1977 <br /> Call from Zaaconia Homes indicating that they <br /> � have first right of refusal on the above purchase <br /> agreement. <br /> � <br /> . Council Meeting - May 23, 19777 <br /> . '�7ayor Van Nest moved, Paurus seconded, to approve <br /> he variance request of Virgil Doerfler, 4799 Tonka <br /> �'iew Lane, subject to: <br /> * 1. Lots 6 & 7 combined with Lots 8, 9, & 10. <br /> 2. Provide access easement to Olson property. <br /> 3. As per the Planning Commission recommendation <br /> • of May 16 , 1977. <br /> Motion, Ayes (4) - Nays (0) . <br /> Henry Muhich, Building & Zoning Administrator, VARIANCE <br /> � read into the record the following concerning 4735 Tonka View Lane <br /> . a variance request of T. Kenneth Rud, 4735 Tonka #253 <br /> View Lane, dated May 2, 1977: T. Kenneth Rud <br /> �r. Ru� was nresent. Planning Commission discussed <br /> proposal as work session item. Indicated some <br /> ob�ection. Suggested combination of four lots as <br /> � one building site similar to adjoining property. <br /> If combined, City would consider waiving balance <br /> of one sewer assessment. <br /> � Planning Commission Meeting - May 16, 1977 <br /> Planning Commission discussed proposal with applicant <br /> � and his attorney. Motion passed to recommend denial <br /> of variance to build on either parcel. The availability <br /> of commonly owned adjacent land would mean that grant- <br /> ing of the variance request would be, in effect, <br /> granting of a non-conforming, substandard lot <br /> division. The Planning Commission also recommended <br /> waiving $2, 388 of unpaid sewer assessments if all <br /> four lots (2 parcels) are combined as one building <br /> site meeting the zoning requirements.
