all storm water management facilities. <br />16. Lighting. Internal street lighting should be at a low level consistent with the <br />surrounding rural residential character while providing the necessary level of <br />security, and will be maintained by the homeowners association. Private street <br />lighting will be provided by the developer, then maintained through standard <br />agreement between the homeowners association and the appropriate public utility <br />company. <br />17. 10% Private Park RPUD Requirement. The private recreation area of `10% of <br />the platted property' required under the RPUD standards will be satisfied by the <br />preservation of the wetland and a passive open space and the provision of trails <br />along Shadywood Road. The Council finds this acceptable given the unique and <br />sensitive features of the site, including the tree cover, wetland, and its location. <br />18. Park and Trail Dedication. There are no identifiable public parkland needs at this <br />location. However, development of the proposed housing will generate additional <br />use of existing City park facilities in the area. The Council finds that no park lands <br />need to be dedicated and the park dedication should be in the form of a Cash <br />Contribution in Lieu of Lands as allowed by the Municipal Code. Additionally, the <br />Council finds that although no public trails along the property boundaries are <br />planned, it would be prudent to obtain a trail easement over the northerly 10 feet of <br />the property for potential future trail use, such easement to coincide with the <br />required 10' drainage and utility easement in that same location. The developer <br />and/or individual property owners shall be allowed to landscape the trail easement <br />area with the understanding that if a future trail is constructed, the landscaping may <br />be at risk and there will be no compensation for its removal as a result of the trail <br />construction. <br />19. Stormwater Management. Stormwater management is proposed to be provided <br />via several methods. The developer proposes to utilize permeable pavers in the <br />driveways, reducing the percentage of hard cover to be below the watershed <br />districts standards for rate and volume control. A storm water pond will be <br />developed at the SE corner of the site, prior to discharge into the system along <br />Shadywood Road. An additional pond will be provided near the SW corner of the <br />developed area, to maintain rate and volume control of storm water prior to entering <br />the wetland complex downstream. The storm water facilities will be subject to <br />standard drainage easements. In addition to the City of Orono, the Minnehaha <br />Page 6 of 15 <br />
