� <br /> � 8.2.1 Requests for review of substitute items of material and equipment wiil not be accepted by <br /> Engineer from anyone other than Contractor. If Contractor wishes to furnish or use a substitute item <br /> � of material or equipment Contractor shall make written application to Engineer for acceptance <br /> thereof, certifying that the proposed substitute will perform adequateiy the functions called for by <br /> the general design, be similar and of equal substance to that specified and he suited to the same use <br /> � and capable of performing the same function as that specified. The application will state whether <br /> or not acceptance of the substitute for use in the Work will require a change in the Drawings or <br /> Specifications to adapt the design to the substitute and whether or not incorporation or use of the <br /> � substitute in connection with the Work is subject to payment of any license fee or royalty. All <br /> variations of the proposed substitute from that specified shall be identified in the application and <br /> available maintenance, repair and replacement service will be indicated. The application will also <br /> ,�, contain an itemized estimate of all costs that will result directly or indirectly from acceptance of such <br /> substitute, including costs of redesign and claims of other Contractors affected by the resulting <br /> � change,all of which shall be considered by Engineer in evaluating the proposed substitute. Engineer <br /> may require Contractor to furnish at Contractor's expense additional data about the proposed <br /> substitute. Engineer will be the sole judge of acceptability, and no substitute will be ordered or <br /> � installed without Engineer's prior written acceptance. Owner may require Contractor to furnish at <br /> Contractor's expense a special performance guarantee or other surety with respect to any substitute. <br /> � 8.2.2 Engineer will record time required by Engineer and Engineer's consultants in evaivating <br /> substitutions proposed by Contractor and in making changes in the Drawings or Specifications <br /> � occasioned thereby. Whether or not Engineer accepts a proposed substitute, Contractor shall <br /> � reimburse Owner for the charges of Engineer and Engineer°s consultants for evaluating any proposed <br /> substitute. <br /> � 8.3 MATERIALS FU�ZNISHED BY OWNER <br /> � 8.3.1 Materials sPecifically indicated shall be furnished by the Owner. Bafore incorporating anv of <br /> the materials into the Work, the Contractor shall inspect the materials so furnished by the C��ri��r. <br /> If the Contractor drscovers any patent defects in material furnished by the Clwner, he shall notify the <br /> � ��gineer. <br /> 8.3.2 Uniess otherwis.,noted or speci�catly stated, materials furnished by the Owner are considered <br /> � to be f.a.b. the nearest railroad station or truck line. The CQntractor shall transport the materials to <br /> the job site, unload and properly protect all such materiais from damage or loss. The Contractor <br /> shall be responsible far material lass or damage after receipt of materials at the point of delivery. <br /> � — - _ _ _ - _ . <br /> 8.4 ST(�RAGE OF MA'�ERIALS <br /> 1 Materials shall be sa stored by the Contractor as to insure the preservation of iheir quality and fitness <br /> for the Work. When cons�dered necessary, they shall be placed on wooden platforms or other hard, <br /> clean surfaces, and/or they shall be placed under cover and not on the ground. Stored mater�als shall <br /> � 6e �ocated so as �o faciiitate �rompt inspection.
