� <br />� 6.2.2 If the Surety on any Bond furnished by Contractor is declared bankrupt or becomes insolvent <br /> or its right to do business is terminated in any state where any part of the Project is located or it <br />� ceases to meet the requirements of clauses (A) and (B) of Paragraph 6.2.1, Contractor shall within <br /> five days thereafter substitute another Bond and Surety,both of which shall be acceptable to Owner. <br />� 6.3 PATENTS. FEES AND ROYALTIES <br /> Contractor shall pay all license fees and royalties and assume ail costs incident to the use in the <br />' performance of the Work of any invention, design, process, product or device which is the subject <br /> o f patent rights or copyrights held by others. If a particular invention, design, process, product or <br /> device is specified in the Contract Documents for use in the performance of the Work and if to the <br />� actual knowledge of Owner or Engineer its use is subject to patent rights or copyrights calling for <br /> the payment of any license fee or royalty to others, the existence of such rights sha11 be disclosed by <br />� Owner in the Contract Documents. Contractor shall indemnify and hold harmless Owner and <br /> Engineer and anyone directly or indirectly employed by either of them from and against all claims, <br /> damages, losses and expenses (including attorneys' fees) arising out of any infringement of patent <br />� rights or copyrights incident to the use in the performance of the Work or resulting from the <br /> incorporation in the�1Vork of any invention, design, process, product or device not sgecified in the <br /> Contract Documents, and shall defend all such claims in connection with any alleged infringement <br />' of such rights. <br /> � �.4 PERMITS AND LICENSES <br />� _ All permits and licenses necessary for the prosecution of the Work shall be secured by the Contractor <br /> prior to the commencement of the Work. Contractor shall also pay all public utility charges, <br />' governmental charges and inspection fees. <br /> 6.5 LAWS. REGULATIONS AND SAFETY <br />� <br /> b.5.1 Contractor shall give all notices and comply with all laws, ordinanees, nales and regulations <br />' applicable ta the Work. If Cantractor observes that the Specifications or Drawings are at vasiance <br /> therewith,he shall give Engineer prompt written notice thereof, and any necessary changes shall be <br /> ac�justed by an appropriate Change Order or other Modification.
