� <br /> The Owner and Contractor waive all rights against each other and the Subcontractors and thzir agents <br /> and employees and against the Engineer and separate Contractors (if any) and their Subcontractors' � <br /> agents and employees,for damages caused by�re or other perils to the extent covered by insurance <br /> provided under this section or any other property insurance applicable to the work. <br /> 6.1.5 Contractural Liability Insurance: To the fullest extent permitted by law, the Contractor shall � <br /> indemnify and hold harmless the Owner and the Engineer and their agents and employees from and <br /> against all claims, damages, losses and expenses, including but not limited to attorneys' fees arising � <br /> out of or resulting from the performance of Work provided that any such claim, damage, loss or <br /> expense (1)is attributable to bodily injury, sickness, disease or death, or to injury to or destruction <br /> of tangible property (other than the Work itsel� including the loss of use resulting therefrom, and ' <br />(2) is caused in whole or in part by any negligent act or omission of the Contractor, any <br /> Subcontractor, anyone directly or indirectly employed by any of them or anyone for whose acts any <br /> of them may be liable, regardless of whether or not it is caused in part by a party indemnified , <br /> hereunder. Such obligation shall not be construed to negate, abridge or otherwise reduce any other <br /> right or obligation of indemnity which would otherwise exist as to any party ar person described in , <br /> this Section. <br /> In any and all claims against the Owner or the Engineer or any of their agents or employees by any , <br /> employee of the Contractor, any Subcontractor, anyone directly or indirectly employed by any of <br /> them or anyone for whose acts any of them may be liable,the indemnification obligation under this <br /> Section shall not be limited in any way by any limitation on the amount or type of damages, ' <br /> compensation or benefits payable by or for the Contractor or any Subcontractor under worker's or <br /> workmen's compensation acts, disability benefit acts or other employee benefit acts. <br /> 6.1.6 Minimum Insuzance Requirements: Losses other than those covered by insurance s�all be the . � <br /> sole responsibility af the Contractors. The insurance requirements as set forth herein shall be <br /> considered to be minimum requirements only. Any other insurance that may be necessary to provide � <br /> adequate coverage must be provided by the Contractors and shall be their sole responsibility. <br /> 6.1.7 Boiler Insurance: If a permanent boiler is to be installed as part of the project, the Owner will ' <br /> be responsible for maintaining all boiler and machinery coverage. This coverage will be placed in <br /> effect when the equipment is ready for inspection and operation. This coverage shall include the ' <br /> interests of the Owner, the Contractor, Subcontractors and Sub-Subcontractors. <br /> 6.2 PERFORMANCE AND OTHER BONDS ' <br /> 6.2.1 Contructor shall furnish Ferformat�ce and P'ayment Bonds, each in an atnoui�t at least equal <br /> to the Contract Price as security for the faithful performance and payment of all Contractor's � <br /> obligations under the Contract Documents. These Bonds shall remain in effect at least until one year <br /> after the date of final payment, except as otherwise provided by law. Contractor shall also fnrnish <br /> such other Bonds as are required by the Contract Documents. All Bonds shall be in the forms � <br /> prescribed by the Contract Docur�ents and be executed by such Sureties as (A) are licensed to <br /> conduct business in the state where the Project is located, and (B) are named in the current list of <br /> Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and as ' <br /> Acceptable Reinsuring Companies" as published in Circular 570 (amended) by the Audit Staff <br /> Bureau of Accounts,U.S.Treasury Department. All Bands signed by an agent must be accompanied <br /> by a certified copy of the aa�thority to act.
