' <br /> SECTION 5 I <br /> AVAII.ABILITY OF LANDS: PHYSICAL � <br /> CONDITIONS; REFERENCE POINTS <br /> 5.1 AVgILABILITI' OF LANDS ' <br /> 5.1.1 Own�r shall furnish, as indicated in the Contract Documents, the lands upon which the Work <br /> is to be performed, rights-of-way for access thereto, and such other lands which are designated for ' <br /> the use of Contractor. Easements for permanent structures or permanent changes in existing <br /> facilities wilt be obtained and paid for by Owner, unless otherwise provided in the Contract , <br /> Documents. <br /> 5.1.2 Contractor shall, at his expense, provide for all additional lands and access thereto that may ' <br /> be required for temporary construction facilities or storage of materials and equipment. Contractor <br /> shall confine his machinery and equipment,storage of materials and operation of workmen to those <br /> areas described in the Contract Documents and such additional areas which he may provide at his ' <br /> expense. <br /> 5.2 PRNATE PROPERTY ' <br /> The Contractor shall not enter upon private property for any purpose without obtaining written <br /> permission from the owner thereof, and he shall be responsible for the preservation of all property, ' <br /> trees, monuments, etc., along and adjacent to the street and/or right-of-way, and shall use every • <br /> precaution necessary to prevent damage or injury thereto. He shall protect carefully from disturbance, <br /> or damage all monuments and property markers until an authorized agent has witnessed or otherwise ' <br /> referenced their locatzon and shall not remove thern until directed. <br /> 5.3 SURVEYS , <br /> Unless otherwise specitied, the Owner shall establish all base lines for the location of the principal ' <br /> component parts of the Work together with a suitable number of bench marks adjacent to the Work. <br /> Based upon the information provided by the Owner,the Contractor shall develop and make all detail <br /> surveys necessary for construction, including batter boards, stakes for pile locations and other � <br /> working points, lines and elevations.
