The Property is served by City sewer. <br /> b. There is no adjaeent property available for the Owner to purchase to <br /> enlarge the property to two acres non-wetland. <br /> c. There has been a house on the property for over 50 years. <br /> d. Although the lot is rectangular the non-wetland portion of the lot is <br /> triangular. Its effective width is 130 feet. <br /> e. The proposed front setback is the same as the adjacent house at 450. A <br /> larger front setback variance would not be compatible with the other <br /> houses on East Long Lake Road. <br /> f. Although the Owner is reducing the size- of the lot by a Lot Line <br /> Rearrangement, the reduction is based on an apparent surveying error made <br /> about 50 years ago that resulted in the neighboring house being on the <br /> Owner's property. The Owner was not aware of the error until after the <br /> property was purchased. The lot line rearrangement and the side setback <br /> variance will allow quick resolution of this very serious problem. The <br /> alternative would be to resolve the problem in the courts. This would be a <br /> severe hardship, both financial and emotional, to the neighboring property <br /> owner. This is a very unique situation. <br /> g. Side setback variances have been granted for properties zoned LR-lA that <br /> are substandaxd in area and width. <br /> h. The house has been designed to fit the shape of the lot as much as possible. <br /> It will be compatible with the character of the surrounding area. <br /> 4. The City Council has considered this application including the findings and <br /> recommendation of the Planning Commission, reports by City staff, comtnents <br /> by the applicants and the public, and the effect of the proposed variance on the <br /> health, safety and welfare of the community. <br /> Page 2 of 5 <br />
