The City Council finds that the conditions existing on this property are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> granting the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the Owner but necessary to alleviate a <br /> demonstrable hardship or difficulty; are necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. - <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants variances to Orono <br /> Municipal Zoning Code Section 78-305 to allow construction of a house on a LR-lA zoned <br /> lot with a defined lot area of 0.59 acre with a 43-foot front setback and a 10-foot south side <br /> setback, subject to the following conditions: <br /> 1. The Lot Line Rearrangement approved by Resolution No. 5735 being put <br /> into effect. <br /> 2. Council approval is based on the site and house plans submitted by the Owner <br /> and annotated by City staff, attached to this Resolution as Exhibits B and C. <br /> Any amendments to these plans may require further Planning Commission and <br /> City Council review. <br /> 3. The Owner shall grant the City a road and utility easement over the westerly_ <br /> 19.58 feet of the property, to reflect the historic right of way of East Long Lake <br /> Road. <br /> 4. The Owner shall execute Flowage and Conservation Easement and Restrictive <br /> Covenant for Wetland and Wetland Buffer prior to issuance of the building <br /> permit for the house. <br /> 5. The Certificate of Occupancy shall not be issued until an as-built grading plan <br /> verifying compliance with engineering and zoning approvals has been <br /> submitted and approved. Any deviation from the approved plan may require <br /> Planning Commission and/or City Council review. <br /> Page 3 of 5 <br />
