The Plamiing Commission reviewed tl�is application at a puUlic hearing <br /> held on November 15, 2004 and reconunended approval of the side <br /> setback variances based on the following findin�s: <br /> a. The applicants' property has 22,215 s.f. or '/2 acre in area and 90' of <br /> width at the shore aud 95' of width at the 7S' setUacl:. <br /> b. No additional land is availaUle for acquisition by the applicants to <br /> malce the property confornling iu area or width. <br /> c. The applicants are proposing to reorient the rooflines; no additional <br /> living space is proposed within the substandard setUacks. <br /> d. Due to the location of the home any additions or alterations to the west <br /> side of the house and detached garage require variances. <br /> e. There is no available land to purchase to mal<e the e�isting side <br /> setbacics confornling. <br /> f. The applicauts are proposing to remove portions Of I]011COI1f0I111111� <br /> hardcover in conjunction with setUacic variance approvals. <br /> g. Since the l�ome and subsequent addition were originally constnicted <br /> the shoreline l�.as eroded mal:ing the previously confonnin� lalce <br /> setback nonconfoi-ming. <br /> 4. The City Council has considered this application including the findings <br /> and reconunendation of the Plaiulin� Cominission, reports by City staff, <br /> comments by the applicants and the puUlic, and the effect of the proposed <br /> variance on the health, safety and welfare of the coirununity. <br /> 5. The City Council finds that the conditions existing on this property are • <br /> peculiar to it and do not apply generally to other property in this zoning <br /> district; that granting the variance would not adversely affect traffic <br /> conditions, light, air nor pose a fire hazard or other danger to ileighboring <br /> property; would not merely serve as a convenience to the applicants, but is <br /> necessary to alleviate a demonstrable hardship or difficulty; is necessary to <br /> presei-��e a substantial property right of the applicants; and would be in <br /> Pa�e2of5 <br />
