- � o� <br /> o �� o <br /> -��a.. _� CITY of ORONO <br /> � � ::�1�" � <br /> RESOLUTION OF THE CITY COUNCIL <br /> G <br /> ��kESI��4� NO. �' � � <br /> keeping with the spirit and intent of the Zoning Code and Comprehensive <br /> Plan of the City. <br /> CONCLUSIONS, ORD�R AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereUy <br /> jrauts a variance to Orono Munic.ipal Zoning Code Section 78-330 Subdivision B to <br /> allo�v side setbacics of 9.3' for the detached �arage and 4.3' for the existing home in order <br /> to reorient the rooflines in conjunction with a partial second story additioi�, a variance to <br /> Orono Municipal Zoning Code Section 78-1288 Subdivision A to allow a second story to <br /> Ue constructed over the e�isting home within 75' of the OHWL and hardcover removals, <br /> subject to the following conditions: <br /> 1. Council approval is based on the site plan suUmitted Uy the applicants and <br /> aiulotated by City staff, attached to this Resolution as Exhibit A. Aily <br /> amendments to the site plan which are not in confoni�ity with City codes will <br /> require fiu-ther Plaiuiin�Commission and City Council review. <br /> 2. Hardcover in the 0-75' zone shall ilot iucrease aUove the level of 12.6%. <br /> . Hardcover in the 75-250' zone shall Ue limited to 4,820 s.f. or 33% per the <br /> proposed plan and hardcover allowance summary as depicted on Exhibit A. <br /> Applicants are advised that any future requests to increase hardcover or change <br /> the nature of existing/approved hardcover shall require City approval, and <br /> increases in hardcover will not likely be approved without concun-ent reduction in <br /> existing hardcover. <br /> 3. Applicants shall remove all plastic or faUric liner material fronl the decorative <br /> landscape Ueds on the property to ensure their penneaUility as non-hardcover <br /> surfaces. <br /> 4. Required reinovals of stnicture and hardcover shall be completed by the final <br /> inspection. <br /> 5. Autl-iorities granted by this resolution nui with the property not with the <br /> applicants, but are pernlissive only and nnist be exercised by obtaining a building <br /> pemiit for the new constniction within one year of the date of Council approval, <br /> or the variance �vill e�pire on that date (DeceuiUer 13, 200�). <br /> Paje 3 of 5 <br />
