MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, April 14, 2014 <br />7:00 o’clock p.m. <br />_____________________________________________________________________________________ <br />  <br />    Page 11 of 30   <br />(10. #14-3658 SUNCREST BUILDERS – WAUSAU HOMES ON BEHALF OF JOHN AND <br /> ALICE REINMANN, 440 BIG ISLAND – VARIANCES AND CONDITIONAL USE <br /> PERMIT – RESOLUTION NO. 6383, Continued) <br /> <br />Levang stated she would like to hear from the property owner on how he feels about the conditions being <br />imposed relating to the septic. <br /> <br />John Reinmann, 440 Big Island, stated they are removing the loft part of the guest cabin off but that he is <br />unsure how the City is calculating it as six bedrooms between the two cabins since only three bedrooms <br />are being proposed for the new structure and the existing cabin is one bedroom. <br /> <br />Curtis stated it is Staff’s understanding that it is a two-bedroom cabin that exists, but that if additional <br />information is provided to Staff reflecting otherwise, they can work with the septic design. Curtis <br />indicated state septic code considers a basement a bedroom regardless if there is a bedroom proposed, <br />which is something that Staff has only learned recently. <br /> <br />Bremer stated if there are three bedrooms on the main floor and a basement, the structure would then be <br />considered a four-bedroom structure. <br /> <br />Reinmann indicated the basement would have one door from the outside and will be used for storage and <br />not a bedroom. <br /> <br />Curtis stated it is Staff’s understanding of the septic code that it has the potential to be a bedroom. Curtis <br />stated she understands the logic behind the state statute but that it was not something that Staff had <br />considered prior to this point. <br /> <br />McMillan noted this will be a seasonal cabin and will not be occupied year-round. <br /> <br />Curtis stated a seasonal cabin may get more intense use in a shorter period of time than a normal <br />residence which is why it is important to understand the sizing of the structures. <br /> <br />Reinmann stated he would have preferred to leave the cabin where it was since it was a natural clearing <br />and that relocating the cabin will require additional trees be removed. Reinmann indicated they are fine <br />with the conditions and that they are willing to work with the City on the septic. Reinmann noted the <br />existing septic system is relatively new and the cabin can only be used 180 days out of the year. <br /> <br />Bremer moved, Levang seconded, to adopt RESOLUTION NO. 6383, a Resolution Granting <br />Variances from Municipal Zoning Code Sections 78-565(2)(b), 78-566(3), 78-568, and a Conditional <br />Use Permit Pursuant to Municipal Zoning Code Section 78-565(2), with the understanding that the <br />resolution will not be filed if the plumbing is removed from the guest cabin.
