REQUEST TO ACCESS 2629, 2627, AND 2625 CASCADE LANE FROM KELLEY <br /> PARKWAY <br /> <br />Struve stated the developer who purchased 32 lots in the Stonebay Development has made a request with <br />Staff to access 2629, 2627, and 2625 Cascade Lane from Kelley Parkway for a limited period of time. <br />These lots currently have access from Cascade Lane, which is a private road and maintained by the <br />homeowners association. Due to load restrictions, the builder requests access to the lots from Kelley <br />Parkway. The developer has indicated he intends to replace all damaged sidewalk, curb, and landscaping. <br />The developer also offered to give the City an escrow in this amount to ensure the work is taken care of <br />appropriately. <br /> <br />Staff has evaluated their request and is recommending denial for the following reasons: <br /> <br />1. The properties have access from Cascade Lane. The homeowners association is enforcing the <br /> load restrictions until the State removes them. Since their access is limited because of road <br /> restrictions, it is Staff’s opinion that this does not fall into an emergency situation where the City <br /> would allow access to the lots from a different roadway. Typically the City never issues <br /> exemptions to road restrictions unless there is an emergency such as well failure or septic or <br /> sewer system failure posing an imminent threat to public health. There is also an exemption for <br /> utility company service vehicles for power outages, gas leaks, emergency communication, line <br /> down, or line severed. <br /> <br />2. Potential impact to the traveling public. <br /> <br />3. Kelley Parkway is a major route for emergency vehicles. By allowing the contractor to use <br /> this area as access, there is potential for the roadway to be blocked when they are bringing in <br /> or taking out materials and equipment. <br /> <br />4. There are trees in this area and their root structure will be impacted. This can take years before <br /> the affects would be visible and the City would not have an escrow to replace them. <br /> <br />5. There are light poles or wiring in this area that could be damaged. <br /> <br />6. While they can replace broken curb and sidewalk, there will be a very noticeable color <br /> difference between the new and the old. It is the viewpoint of Staff that this would be a visual <br /> impairment for many years to come. <br /> <br />7. There will be damage to the roadway that cannot be feasibly corrected by their equipment. For <br /> instance, the excavator will more than likely create indents into the pavement that cannot be <br /> easily repaired. <br /> <br />Bill Gleason, Developer, stated they now own 32 lots in the Stonebay neighborhood and would like to <br />construct model homes on three of the lots that are adjacent to Kelley Parkway. Gleason stated one of the <br />difficulties they have run into is that the model home that currently is located on one of the lots is not the <br />type of home that can be built on the remaining lots since they are smaller sized lots. <br /> <br /> <br />Item #02 - CC Agenda - 04/28/2014 <br />Approval of Council Minutes 04/14/2014 <br />[Page 12 of 30]
