MINUTES OF THE <br />ORONO PLANNING COMMISSION MEETING <br />Monday, May 19, 2014 <br />6:30 o’clock p.m. <br />_____________________________________________________________________________________ <br />  <br />Page 28 of 31  <br />  <br />Leskinen noted the Planning Commission has previously discussed this application multiple times and <br />that the applicant is merely asking for a renewal of his prior approvals. <br /> <br />It was the consensus of the Planning Commission to forego Staff’s report. <br /> <br />Chair Leskinen opened the public hearing at 9:37 p.m. <br /> <br />There were no public comments regarding this application. <br /> <br />Chair Leskinen closed the public hearing at 9:37 p.m. <br /> <br />Curtis noted the wetland regulations changed since the original approval and that currently no variance is <br />required to the wetland buffer. In addition, the reporting of the hardcover has also changed and the <br />applicant has updated his information with the City. <br /> <br />Leskinen asked if the changes are stricter. <br /> <br />Curtis indicated they are not and that the change merely modifies how those numbers are reported. <br /> <br />Schwingler moved, McGrann seconded, to recommend approval of Application No. 14-3668, <br />Charles Cudd DeNovo on behalf of Mary J. Bowman Trust, 1165 Ferndale Road West, renewal of <br />variances and conditional use permit, per Staff’s recommendations. VOTE: Ayes 7, Nays 0. <br /> <br />7. 14-3669 DALE GUSTAFSON ON BEHALF OF MARK AND KRISTEN ANDERSON, <br />3850 WATERTOWN ROAD, CONDITIONAL USE PERMIT, 9:39 P.M. – 9:45 P.M. <br /> <br />Dale Gustafson, Applicant, was present. <br /> <br />Curtis stated the applicant is requesting a conditional use permit in order to conduct land alterations on <br />the property resulting in approximately 10,000 cubic yards of fill material. The applicant is proposing to <br />create a level paddock and pasture area for their horses west of the barn. The disturbed area will be <br />planted with a pasture mix. Because the amount of fill exceeds 500 cubic yards, a conditional use permit <br />is required. <br /> <br />As it relates to the conditional use permit criteria, Staff has found that the proposed grading is consistent <br />with the permitted uses for the property and is compliant with the zoning code and comprehensive plan. <br />Staff believes the grading on the property will have no impact on surrounding lands and the grades, once <br />vegetated, will blend into the rest of the pasture acreage. The proposed grading will also not change the <br />intended residential use of the property so there should be no change in the use and enjoyment of adjacent <br />properties. <br /> <br />The applicant will be required to keep debris off of the public roadways. In addition, the grading project <br />has been evaluated by the City Engineer and Planning Staff and should not create a nuisance situation. <br />The proposed project will not impact the wetland and will have minimal, if any, environmental impacts. <br />The applicant has proposed a re-vegetation plan resulting in a continuance of the pasture area.
