City Administrator <br /> Date: December 1, 2014 <br /> Subject: Storm Water & Drainage Trunk Fee Issues <br /> Summary: In May 2014 staff presented the City Council with a number of issues <br /> related to the Storm Water & Drainage Trunk Fee (SW&DT Fee) suggesting the need <br /> for potential Code amendments and/or a re-interpretation of the SW&DT Fee provisions <br /> in light of Council actions and staff discussions over the past two years. <br /> Attachments: <br /> 1. May 2014 Council Work Session Memo with attachments: <br /> A - Pertinent Ordinances - Municipal Code Sections 14-281 thru 14-287 <br /> B - History of SW&DT Fees Collected (Single-family residential projects) <br /> C - 2014 Fee Schedule Excerpt - SW&DT Fees <br /> 2. December 2014 Updated & Expanded History of Collected Fees <br /> Discussion <br /> Please review the Memo and attachments from the May Council 2014 Work Session for <br /> a detailed background on the SW&DT Fee and a review of the primary issues <br /> surrounding it. At that work session, Council generally agreed that the SW&DT Fee <br /> structure needs to be reconsidered per the 4 discussion points on page 9 of the May <br /> memo. Additionally, the Lakeview Golf development application process has added the <br /> issue of the sheer magnitude of the fee for a large development. To address the above, <br /> staff is suggesting the following process: <br /> - analyze the methodology to determine whether there are inequities between the fee <br /> charged for large lots versus small lots; <br /> - review how the fee relates to hardcover levels and hardcover increases or <br /> decreases, as well as the use of BMPs to minimize runoff leaving the site; <br /> - examine how the fee takes into consideration on-site stormwater improvements, and <br /> consider adopting standards for fee credit for off-site improvements <br /> - consider whether the triggers for charging the fee are 1) clear and 2) appropriate; <br /> - draft a definition for `new development' relative to the fee; <br /> - review and reconsider the parameters and basis for charging the fee for <br /> `redevelopment'; and <br /> - establish standards defining how past fees paid are credited for future development <br /> of a site. <br />
