� <br /> Section 6.05, Subdivision 1(A) and Subdivision 1(B) and <br /> Section 6.05, Subdivisions 2, 3 and 4 of the City of Orono <br /> Municipal Code is amended to read as follows : <br /> SEC. 6.05. CONSTRUCTION AND RECONSTRUCTION OF PUBLIC ROADWAY, <br /> SURFACING, SIDEWALK, CURB AND GUTTER, DRIVEWAY OR CURB CUTS. <br /> Subd. 1. Methods of Procedure. Abutting or affected <br /> property owners wishing to contract for, construct or reconstruct <br /> public roadway surfacing, sidewalk, curb and gutter, driveway, <br /> driveway approaches, driveway turnarounds, or curb cuts must first <br /> obtain a permit from the City in accordance with this Section. <br /> Also, with or without petition by the methods set forth in the <br /> Local Improvement Code of Minnesota Statutes, presently beginning <br /> with Section 429.011, as the same may from time to time be amended. <br /> Subd. 2 . Requirament and Application for Permit. It is <br /> a misdemeanor to construct or reconstruct a sidewalk, curb and <br /> gutter, driveway, driveway approach, driveway turnaround, curb <br /> cuts, roadway surfacing or any other private improvement in any <br /> public road or other public property in the City without a permit <br /> in writing from the City. Application for such permit shall be <br /> made on forms approved and provided by the City and shall <br /> sufficiently describe the contemplated improvements, the <br /> contemplated date of beginning of work, and the length of time <br /> required to complete the same, provided that no permit shall be <br /> required for any such improvement ordered installed by the <br /> Council. Such application shall also contain inform3tion showing <br /> the type of construction, the width and the location of an <br /> improvement on the parcel of land and the lot and block number or <br /> the parcel number and the street and house number and a profile of <br /> the �roposed improvement, if necessary, and other such information <br /> as may be requir�d by the Public Works Director. The application <br /> shall be filed by the property owners desiring to construct such a <br /> driveway approach, driveway turnaround, sidewalk, curb and gutter, <br /> driveway, curb cut, roadway surfacing or private improvements in <br /> any public road or any property in the City, or by his or her duly <br /> authorized agent. All such applications shall contain an <br /> agreement by the applicant to be bound by this Chapter. A permit <br /> from the City shall not rel.ieve the holder from damages to the <br /> person or property of another caused by such work. T'hese <br /> regulations shall apply to all City, State and County roads . <br /> Subd. 3 . Issuance of Permit. Such permit shall be <br /> issued by the . Public Works Director, if he or she has determined <br /> that the applicant has complied with the terms of this ordinance, <br /> the permit fee hereinafter specified has been paid and the Public <br /> Works Director has approved the driveway, driveway approach, <br /> driveway turnaround, sidewalk, curb and gutter, curb cuts, roadway <br /> surfacing or private improvement in any public road or other <br /> public property in the City as requested or with stipulated <br /> changes. The Public Works Director shall have the authority to <br /> -3- <br />
