<br /> <br /> <br />ORDINANCE NO. ___, THIRD SERIES <br /> <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br /> <br />AN ORDINANCE AMENDING THE ORDINANCES PERTAINING TO DOGS IN AN <br />OFF LEASH PARK <br /> <br /> <br />THE CITY COUNCIL OF ORONO ORDAINS: <br /> <br /> SECTION 1. Section 22-95 (1) Animal regulations is hereby amended to read as follows: <br />No person shall: <br />(1) Except as provided in Minn. Stat. § 256C.02, bring or keep an animal owned or under his <br />control into or upon a park. This subsection does not prohibit dogs or cats that are on leashes or <br />dogs in an area designated as an off leash area provided that the person having custody of the <br />animal: is present with the animal; has a current off leash permit; and is acting in compliance <br />with the rules and regulations of the off leash areas <br /> <br /> SECTION 2. Chapter 22 Parks and Recreation is amended by adding the following: <br />Sec. 22.102 - Off leash dog areas; permits and regulations. <br />(a) Dogs may be unrestrained by chain or leash in areas designated for off leash activities by the <br />City. No person shall use a designated off leash area without first having obtained a permit for <br />each dog using such an area from the City of Orono. A dog deemed a dangerous animal under <br />Code 62-102, or as a dangerous or potentially dangerous dog as defined under Minnesota Statute <br />347.50, is not permitted to use off leash areas. <br />(b) The annual fee for an off leash area permit shall be set City Council and published in the <br />Annual Fee Schedule. A permit may only be issued upon verification of rabies vaccination. <br />Permits shall be valid from the time they are issued until December thirty-first after the date of <br />issuance. <br />(c) Upon application for a permit, the applicant shall be provided with the rules for use of off <br />leash areas. As a condition for the issuance of a permit, the applicant shall sign and agree to <br />abide by these rules. <br />(d) Feces clean up. Any person having the custody or control of any dog or domestic animal <br />shall have the responsibility for cleaning up any feces of the animal and disposing of such feces <br />in a sanitary manner. It shall furthermore be the duty of any person having custody or control of <br />any dog or domestic animal on or about any public place to have in such person's possession <br />suitable equipment for picking up, removal and sanitary disposal of animal feces. Violations of <br />this provision may result in an administrative fine. <br />(e) The person responsible for a dog must have the dog restrained when entering and leaving an <br />off leash area. If so directed by a law enforcement officer, animal care and control officer, or <br />animal warden, persons using an off leash area must immediately restrain their dogs and remove <br />them from the off leash area. <br />(f) Enforcement. <br />Exhibit E. <br />Ordinances
