� � <br /> � <br /> Accessory Uses and Structures <br /> February 14,2013 <br /> Page 2 <br /> In reviewing the various types of accessory structures, it is important to remember that there is a <br /> distinction between the terms "building" and"structure". All buildings are structures; but not all <br /> structures are buildings. The definitions of each are shown below: <br /> Building means any structure having a roof which may provide shelter or enclosure of <br /> persons, animals or chattel; and when the structure is divided by party walls without opening, <br /> each portion of such building so separated shall be deemed a separate building. <br /> Structure means anything which is built, constructed or erected, an edifice or building of any <br /> kind, or any piece of work artificially built up or composed of parts joined together in some <br /> definite manner, which requires a location on, below or above the ground, land or water, or <br /> attached to something having a location on the ground, land or water. <br /> Each of Orono's residential zoning districts specify a list of permitted accessory uses. These are <br /> included with this packet as Exhibit A. <br /> General performance standards for accessory uses and structures pertinent to all residential <br /> districts are contained within a variety of sections under the heading of Chapter 78, Article X: <br /> Supplementary Requirements and Restrictions. These sections are included with this packet as <br /> Exhibit B. A brief summary of each section follows: � <br /> 78-1366: Height of Structures <br /> - contains a list of structures the permitted height of which can be increased <br /> by 50%over code standards via CUP; <br /> - allows additional 12' height on lots with slope>25% at house site <br /> 78-1372: Dwelling Use Prohibited <br /> � - disallows use of cellars, basements,tents, trailers or accessory buildings as <br /> a dwelling unit <br /> 78-1376: Home Occupations . <br /> - establishes standards for use of accessory structures in relation to a home <br /> occupation <br /> 78-1403: Lot Covera�e <br /> - indicates that accessory structures are included in lot coverage calculation <br /> 78-1404: Tennis Courts, Pools, Paddocks and Arenas <br /> - establishes front, rear and side setback requirements for these accessory <br /> structures <br /> 78-1405: Non-encroachments <br /> - lists a variety of structures, structural elements, fixtures, etc. that are non- <br /> encroachments, i.e. that are allowed to be located within required yards. <br /> . Many of the listed items are allowed as non-encroachments provisionally, <br /> when they meet certain standards defined in the listing. Items listed as <br /> non-encroachments include, among others, fences which are subject to a <br /> detailed list of standards. � <br />
