MINUTES OF THE ORONO COUNCIL MEETING OF SEPTEMBER 25, 1989 <br />ZONING FILE #1441 - COPLEY CONTINUED , <br />said that the variance being requested is not that significant <br />and felt it should be granted. Mrs. Copley said that it would be <br />difficult to back down the driveway safely because of the steep <br />hill. She said that there are quite a few joggers, walkers and <br />children along the highway. Acting Mayor Callahan said that the <br />Council concurred that there should be a turn around. Motion, <br />Ayes =3, Peterson, Nay, Motion passed. <br />#1442 LANDSCHUTE GROUP, INC. <br />375 LEAF STREET /3300 BAYSIDE ROAD <br />PRELIMINARY PLAT APPROVAL <br />RESOLUTION #2705 AMENDED <br />Mr. Jon Monson was present for the review of this <br />application. <br />City Administrator Bernhardson explained that this matter <br />had previously come before the Council and had been tabled <br />pending a joint meeting with the applicant and the adjacent <br />property owners. The neighbors had expressed concerns about the <br />location of the driveway in conjunction with their property, and <br />the culvert size. The City Engineer has recommended that a 24" <br />culvert be installed. The applicant has relocated the driveway <br />to be more in the center of the lot but it will need to curve to <br />the west to avoid the septic sites. This configuration raised <br />the concern of lights striking the adjacent house to the west. • <br />Assistant Planning and Zoning Administrator Gaffron said <br />that the issue of screening has not yet been addressed by the <br />applicant. <br />Mr. Monson said that he had met with the neighbors and an <br />agreement had been reached that should screening be needed, he <br />will provide "softening" of the lights. He said that he could <br />not promise to totally eliminate the shining of the lights, but <br />he would try to diminish the impact to an acceptable level. <br />Mr. Don Boylan, 3240 Bayside Road, said that he was <br />concerned about the line of evergreen trees bordering his <br />property being removed. <br />Mr. Dale Nyhammer, 3280 Bayside Road, said that the proposal <br />for the culvert and the relocation of the driveway adequately <br />addressed his concerns. He too expressed concern about the <br />preservation of trees along the north side of his property. <br />Acting Mayor Callahan questioned Mr. Nyhammer as to whether <br />he had spoken with the developer in that regard. <br />Mr. Nyhammer said that he had just recently discussed this <br />issue and that Mr. Monson seemed to agree to keep tree removal <br />minimal. is <br />Mr. John Wojcik, 3310 Bayside Road, said that he had no <br />problem with the developer's proposal as long as his concern <br />10 <br />
