MINUTES OF THE ORONO COUNCIL MEETING OF JULY 24, 1989 <br />ZONING FILE #1412 - PETERSEN CONTINUED • <br />said that perhaps this matter should be tabled to allow time for <br />the Park Commission review of the foot path. <br />Ms. Petersen indicated that she would prefer that <br />preliminary approval be given at this time so she could proceed. <br />Councilmember Nettles asked about the degree to which <br />Chippewa Lane was developed. Mabusth replied that there were 10 <br />to 11 residences in that area. Nettles said that Outlot B would <br />be an attractive way for those property owners to access McCulley <br />Road. Ms. Petersen said that those residents were the same <br />people who signed a petition opposing Outlot B. <br />It was moved by Acting Mayor Callahan, seconded by <br />Councilmember Goetten, to adopt Resolution #2665, approving the <br />preliminary plat for Mary L. Petersen. Motion, Ayes =3, Nays =O, <br />Motion passed. <br />#1416 JEFFREY ECCLES <br />3025 SIXTH AVENUE NORTH <br />VARIANCE <br />RESOLUTION #2666 <br />Mr. Eccles was not present for this matter. <br />City Administrator Bernhardson explained that the applicant <br />was seeking variance approval to construct a garage in a • <br />substandard setback. <br />It was moved by Councilmember Nettles, seconded by Acting <br />Mayor Callahan to adopt Resolution #2666, approving the side <br />setback variance to construct an attached garage. Motion, <br />Ayes =3, Nays =O, Motion passed. <br />#1420 KEVIN NORWOOD <br />1300 VINE PLACE <br />DENIAL RESOLUTION #2667 <br />Mr. Earl Norwood was present for this matter. <br />City Administrator Bernhardson reported that staff had <br />calculated the amount of the sewer assessment refund to be <br />$5,905.84. There have been no previous cases where the City has <br />refunded such assessments. <br />Mr. Norwood said that he had hoped to build a second house <br />on the property and was now unsure as to what he could do with <br />it. Mr. Norwood further said that his attorney indicated that he <br />would have a good case against the City if he was not forwarned <br />about the inability to build once he combined the lots. <br />Councilmember Goetten said that the City had to be careful <br />in regard to future applications such as this, but she felt that • <br />a refund was a fair solution to this matter. <br />City Administrator Bernhardson said this application could <br />8 <br />
