The City Council finds that the proposed land alteration allowed by the <br /> conditional use permit would not be detrimental to the public health, safety or <br /> welfare, or materially injurious to properties or improvements in the vicinity. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon the above findings, the Orono City Council hereby grants the followin� <br /> variances: <br /> • to Orono Code Section 78-305(b) to construct a replacement residence on a lot with <br /> an area of 0.63 acres and a defined width of 0 feet when 2.0 acres and 200 feet of <br /> width are required, <br /> • to Orono Code Section 78-305(b) to construct a replacement residence on the Property <br /> with a side setback of five feet when a 30 foot setback is required, <br /> • to Orono Code Section 78-1279 to construct a replacement residence on the Property <br /> with a lake setback of 12 feet when a 75 foot setback is required, <br /> • to Orono Code Section 78-1119(a) to construct a replacement residence on the <br /> Property with a floodplain setback of three feet when a 15 foot setback is required, and <br /> � to Orono Code Section 78-1288 to construct a replacement residence on the Property <br /> with 32.34 percent hardcover in the 0 �0 75 foot zone when no hardcover is allowed, <br /> subject to the following conditions: <br /> 1. Council approval is based on the site and house plans submitted by the Owner <br /> and annotated by City staff, attached to this Resolution as Exhibits A and B. <br /> Any amendments to these plans may require further Plannina Commission and <br /> City Council review. � <br /> 2. Council approval is for construc�ion of a new structure on the existing <br /> foundation, modified as described in the attached as Exhibit C. <br /> Page4of6 <br />
