Hardcover in the 0-75' zone shall be limited to 6,684 square feet impermeable <br /> and 2,215 permeable per the proposed site plan and hardcover allowance <br /> summary as depicted on Exhibit D. The Owner is advised that any future <br /> requests to increase hardcover or change the nature of existing/approved <br /> hardcover shall require City approval, and increases in hardcover will not <br /> likely be approved without concurrent reduction in existing hardcover. <br /> 4. A lakeshore buffer shall be maintained in the area shown on Exhibit A and <br /> subject to a protective covenant. The buffer shall be improved according to the <br /> standards for a wetland buffer found in Orono Code Section 78-16-5(b), <br /> subject to approval by the City's wetland consultant. <br /> 5. Owner shall not place any plastic or fabric liner material under any landscaping <br /> on the property to ensure their permeability as non-hardcover surfaces. <br /> 6. The Property shall be one tax parcel. <br /> The Orono City Council grants a conditional use permit for land alteration to perform mare <br /> than 10 cubic yards of earth movement within the 0 to 75 foot zone in order to rearrange the <br /> floodplain on the Property, subject to the following conditions: <br /> l. Council approval is based on the grading and floodplain mitigation plan <br /> submitted by the Owner and annotated by City staff, attached to this <br /> Resolution as Exhibit E. Any amendments to these plans may require further <br /> Planning Commission and City Council review. <br /> 2. Trees shall be planted and maintained per the planting plat attached to this <br /> Resolution as Exhibit F as annotated by Staff. <br /> Authorities granted by this resolution run with the Property not with the Owner, but are <br /> permissive only and must be exercised by obtaining a building permit for the new <br /> construction before June 8, 2010 or the variances and conditional use permit will expire on <br /> that date. <br /> These variances supersede the variances granted for the Property by Resolution No. 1614. <br /> Violation of or non-compliance with any of the terms and conditions of this resolution shall <br /> constitute a violation of the zoning code, shall automatically terminate any authority granted <br /> Page 5 of 6 <br />
