A house has existed on the lot for many years. <br /> v. No alternative location exists for a house as no part of the property <br /> is outside the 0 to 75 foot zone. <br /> vi. The new house will be properly elevated out of the floodplain. The <br /> garage, laundry room and crawlspace of the existing house are <br /> below the floodplain elevation. <br /> vii. The amount of hardcover will be reduced and partially mitigated by <br /> the use of permeable paving materials and lakeshore buffering. <br /> b. Approval of the conditional use permit based on: <br /> i. The City Engineer indicates the proposed rearrangement of the <br /> floodplain will not decrease the flood storage capacity of the <br /> property. <br /> ii. While the grading will require the removal of a number of large <br /> trees, there is no practical alternative to elevating the driveway on <br /> fill and no otl7er location on the property to provide the <br /> compensatory flood storage capacity. <br /> 4. The City Council has considered this application including the findinas and <br /> recommendations of the Planning Commission, reports by Cityy staff, <br /> comments by the applicant and the public, and the effect of the proposed <br /> variances and conditional use permit on the health, safety and welfare of the <br /> community as well as the impact on properties in the vicinity. <br /> 5. The City Council finds that the conditions existing on this propert}� are peculiar <br /> to it and do not apply generally to other property in this zoning district; that <br /> grantin� the variances would not adversely affect traffic conditions, light, air <br /> nor pose a fire hazard or other danaer to neighboring property; would not <br /> merely serve as a convenience to the Owner but is necessary to alleviate a <br /> demonstrable hardship or difficulty; is necessary to preserve a substantial <br /> property right of the Owner; and would be in keeping with the spirit and intent <br /> of the Zoning Code and Comprehensive Plan of the City. <br /> Page 3 of 6 <br />
