MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD FEBRUARY 23, 1987 <br />'DINANCE AMENDMENT CONTINUED <br />It was moved by Councilmember Callahan, seconded by <br />Councilmember Sime, to adopt Ordinance No. 29 Second <br />Series, subject to amending Section 10.20 Subdivision <br />3(D) as follows: <br />Public service structures as defined above that have <br />been approved by the City at required public <br />hearings for public improvement projects shall not <br />require a conditional use permit but such structures <br />shall be subject to ' all other appropriate standards c <br />set forth in the setion; amendments to approved <br />plans involving design and /or placement of these <br />structures will require written notice by the City <br />to all affected property owners 14 days prior to the <br />adoption of the amended plans by the Council. <br />Motion, Ayes 5, Nays 0. <br />Councilmember Callahan noted that he is very much in <br />favor of the guest apartment use still requiring a <br />conditional use permit. <br />#1059 WILLIAM SCHAFER (MARGARET BJORR) <br />2259 SHADYWOOD ROAD <br />VARIANCE - CONDITIONAL USE PERMIT <br />RESOLUTION #2133 <br />City Administrator Bernhardson explained that this <br />request was previously tabled at the January 12th <br />Council meeting at the request of the new owner of the <br />property. The application is a request to create a legal <br />duplex on a property on the corner of Shadywood and the <br />railroad tracks that has a long history of having a <br />commercial use with an apartment in upper level, in 1976 <br />a guest apartment use was approved in lower level which <br />subsequently became a rental unit. When the property <br />was put up for sale, application was made to either <br />declare the property as a legal duplex or single family <br />home. He reviewed the new owners proposed deadline <br />dates with the conditions of approval based on his <br />occupancy of the residence on May 1st. Staff <br />recommended that appropriate security be posted to <br />ensure that the conditions are completed or require no <br />rental use commence until all the conditions are met. <br />Mr. Schafer was present and stated he had no problem <br />with the conditions of approval nor with the deadline <br />dates recommended by staff. He stated that the <br />apartment is currently occupied by renters. <br />Mayor Grabek suggested that with the completion dates <br />incorporated in the resolution, if compliance is not <br />met, the conditional use permit would be terminated as <br />stated in Condition #6. <br />4 <br />
