MINUTES OF THE REGULAR ORONO COUNCIL MEETING HELD JANUARY 13, 1986 <br />1987 R.J. BAUMAN continued 4 <br />Councilmember Frahm stated that he felt uncomfortable <br />because of the neighbors objections. He also had <br />problems with approving the hardcover variance even <br />though there was a trade -off involved. <br />Mr. Bauman noted that there would be no more hardcover <br />than exists now after the trade -off is made. He stated <br />that he felt that the proposed plan does not encroach <br />upon the neighbors views and he explained his <br />interpretation of the average setback as it related to <br />the shoreline. <br />Assistant Zoning Administrator Gaffron agreed that there <br />were several ways to interpret the average setback line <br />in this case. <br />Mr. Bauman stated that regarding the hardship question, <br />it would depend on whether one considered not being able <br />to have a swimming pool was a hardship. He noted that <br />because of the property layout, there was no other site <br />for the pool. <br />City Administrator Bernhardson recommended tabling this <br />matter for two weeks to 1) review the interpretation of <br />the code regarding average setbacks, 2) contact <br />neighbors regarding their position, and 3) explore <br />alternative sites with applicant. <br />It was moved by Councilmember Hammerel, seconded by <br />Councilmember Grabek, to table this matter until the <br />January 27th Council meeting per City Administrator <br />Bernhardson's recommendation. Motion, Ayes 4, Nays 0. <br />#979 DONALD C. WILDMAN <br />280 WAKEFIELD ROAD <br />AFTER -THE -FACT VARIANCE <br />RESOLUTION #1902 <br />City Administrator Bernhardson explained the request for <br />an after - the -fact 3' side setback variance for a tennis <br />court which was constructed without a building permit by <br />the previous owner, Donald C. Wildman. He noted that <br />the tennis court was constructed over the secondary <br />septic system site, which if the primary site failed <br />there would be no secondary site. A new site on the <br />property has now been located. <br />Donald C. Wildman was not present for this matter. <br />It was moved by Councilmember Hammerel, seconded by <br />Acting Mayor Adams, to adopt Resolution #1902 approving <br />the after - the -fact side setback variance.
