VOTE: Ayes 5, Nays 0. <br />*( #5) #2525 LARRY JACOBSON AND VICKIE O'NEILL, 635 FERNDALE ROAD <br />NORTH - VARIANCE - RESOLUTION NO. 4386 <br />Sansevere moved, Peterson seconded, to approve and adopt RESOLUTION NO. 4386, <br />a Resolution Granting a Variance to Permit a Side Yard Setback to Allow a 612 Square <br />Foot Two -Stall Attached Garage for the Property Located at 635 Ferndale Road North. <br />VOTE: Ayes 5, Nays 0. <br />*( #6) #2530 WILLIAM WEAR, 2160 WAYZATA BOULEVARD - VARIANCE <br />Troy Ramhill, Conoco owner, was present. <br />Weinberger remarked that little progress has been made on the canopy lights with Mr. Wear, • <br />noting that City Staff is attempting to work with the Applicant on finding alternative lighting. <br />Mayor Jabbour noted that the lighting must be approved in order to be in compliance with the <br />conditional use permit. <br />Ramhill indicated that he is not aware of the problem concerning the lights, noting that he was <br />under the impression that they had previously been approved. <br />Mayor Jabbour stated that the lights are supposed to be recessed can lights with the light <br />reflected down towards the ground rather than out. Jabbour stated he receives a number of <br />calls per day regarding this issue. <br />Kelley stated that William Wear has been made aware of the situation and is obligated to <br />bring the lights into compliance. Kelley commented that the occupancy permit should not have <br />been issued until everything was in compliance. <br />Mayor Jabbour noted that the City has sent Mr. Wear a letter notifying him of the situation. <br />Ramhill commented that Wear is having problems with the installer of the canopy. <br />Mayor Jabbour stated that the City Council cannot approve the signage until the other item is <br />brought into compliance. • <br />
