� � -• , � <br /> � � C�t o� ORONO <br /> � <br /> • � RESOLUTION OF THE CITY COUNCIL <br /> � NO. 2816 <br /> • - • • <br /> NOW, THEREFORE BE IT RESOLVED, that based upon one or <br /> more of the findings noted above, the City Council of the City of <br /> Orono hereby approves the preliminary plat far Caro1 J. Kelly at <br /> the property located at 3020 Casco Point Road per the survey <br /> originally dated 5/21/90, revised 6/4/90 by Pete J. Rnabb af Ron <br /> Rrueger & Associates, Inc., subject to the fo'1lowing conditions: <br /> l. The following improvements must be completed prior to <br /> final plat approval: <br /> a) Realignment of drainage ditch as sho.wn on survey <br /> noted above. <br /> b) Removal of 923 square feet of existing hardcover on <br /> proposed Lot 1 as shown on the survey,` noted above <br /> (revised date 6/4/90 ) . <br /> 2 . Upon application for a building permit for new <br /> construction on Lot 2, the future owner shall pay the�� <br /> following sewer and water fees: , <br /> • Sewer unit charge $1,513.86 <br /> Water unit charge 1,691.78 <br /> It should also be noted that this rate is based on the 1990 <br /> fee schedule and will be� adjusted based on the inf lationary <br /> rate for each annual fee schedule. <br /> 3. The subdivider sha11 execute a restrictive covenant to <br /> be drafted by the City to be filed against the chain of <br /> " titles of Lots 1 and 2 denying a11 riparian access and use <br /> of the lake via Lot 1 by Lot 2 of this subdivision. . <br /> 4. Current and future owner of Lot 1 is hereby advised that <br /> hardcover within the 75-250' setback area is at maximum <br /> a1 lowed level at 25g. Any additional improvements to this <br /> property resulting in increases in hardcover must be <br /> approved by the City af Orono and may result in equal or <br /> greater remaval of existing hardcover. <br /> Page 2 of 4 <br /> • <br />
