MINUTES OF THE <br /> � ORONO PLANNING COMMISSION <br /> Monday,September 18,2006 <br /> 6:00 o'clock p.m. <br /> 8. #06-3211 TED CAPRA,,3534 IVY PLACE,VARiANCE,9:28—9:41 P.M. <br /> Ted Capra,Applicant, and Jeff Danbei7y,Builder,was present. � � <br /> Curtis stated in April of 2005,the applicants received a variance in order to const�•uct a new hon�e on their <br /> property to allow 30 percent hardcover within the 75-250 foot zone where 25 percent fiardcover is <br /> normally allowed. In tlie time necessary to finalize the home design and prepare the buildings plans for a <br /> building permit,the hardcover variance expired. The applicant is now requesting a renewal of variances <br /> granted in 2005 in order to construct a new residence on an existing lot. The proposed house has an <br /> expanded footprint compared to that approved in 2005,but renlains within the hardcover and lot coverage <br /> parameters approved. The following items are included in this rene�val request: <br /> 1. Hardcover variance to pernlit 30 perceiit hardcover within the 75-250 foot zone where 25 percent <br /> is normally allowed. � <br /> 2. Conditional use pernut to allow land alterations within the 0-75 foot zone. <br /> Curtis stated the applicant has indicated the proposed driveway is necessaiy for him to pull in and out of <br /> his property with a truck and boat, and reconunended the Planning Conunission discuss that issue. <br /> Planning Staff reconunends approval of the hardcover variance. Staff also recommends approval of the <br /> conditional use perniit to allow minimal grading within 75 feet of the lake in accordance with the City <br /> Engineer's reconunendations. The applicant would still be able to achieve a walk-out style home witllout <br /> the extensive grading. <br /> ,_ Capra indicated he was uot able to commence const�uction on the house due to health problems <br /> experienced Uy his wife. Suice that time he has atteinpted to redesign the house to a one-story,walk-out <br /> house to meet their needs. Capra stated he has not Ueen able to design a one-story house within the 30 <br /> percent hardcover that was previously approved. <br /> Capra stated it would be easier to design a reasonable house if pernieable pavers were allowed in Orono, <br /> noting that there are other ways to llandle water runoff without being so restrictive on the hardcover. <br /> Capra stated it is necessary for hiin to back up into the neighUor's driveway with his boat because his ovtni <br /> driveway cannot accoirimodate it. <br /> Bremer o�ened the public hearing at 9:35 p.m. <br /> Maty Drazan, 3546 Ivy Place, stated she would Ue in sup�ort of 35 percent hardcover. <br /> Jeff Danbeiry requested the Planning Conuiiission allow additional hardcover to eiiaUIe the applicant to <br /> tum around in his own driveway. <br /> Bremer closed the public hearing at 9:36 p.rn. <br /> PAGE 23 <br />
